HomeMy WebLinkAbout09605ORDINANCE NO. 9605 AN ORDINANCE AMENDING ZONING RESTRICTIONS TH FOR PROPERTY LOCATED AT 1322 AND 1348 EAST 8 STREET FROM B-2, SUBREGIONAL BUSINESS DISTRICT TO R-5, MULTIPLE-RESIDENTIAL AND OFFICE DISTRICT BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering the following described property, and in addition half of all adjacent dedicated roadway and alley rights-of-way, together generally identified in the attached Rezone Exhibit is hereby changed from B-2, Subregional Business District To R-5 Multiple-Residential and Office District: LOTS 1 THRU 26 AND LOTS 35 THRU 52, IN BLOCK 121 OF FLETCHER HILL ADDITION PARCEL SIZE: 3.18 ACRES SECTION 2. The officers and staff of the City are authorized and directed to perform any and all acts consistent with the intent of the Ordinance to implement the policies and procedures described herein. SECTION 3. This Ordinance shall become effective immediately upon final action by the Mayor and City Council. Gradisar, Mayor VIA: Brenda Armijo, City Clerk FROM: Scott Hobson, Acting Director of Planning and Community Development SUBJECT: AN ORDINANCE AMENDING ZONING RESTRICTIONS FOR PROPERTY TH LOCATED AT 1322 AND 1348 EAST 8 STREET FROM B-2, SUBREGIONAL BUSINESS DISTRICT TO R-5, MULTIPLE-RESIDENTIAL AND OFFICE DISTRICT SUMMARY: The applicant is requesting to rezone the subject properties from Subregional Business District (B-2 zone) to Multiple-Residential and Office District (R-5 zone). PREVIOUS COUNCIL ACTION: None. BACKGROUND: Applicant is requesting to rezone Lots 1 thru 26 and Lots 35 thru 52, in Block 121 of Fletcher Hill Addition to the City of Pueblo from B-2 to R-5 for Pueblo Community Health Center redevelopment. Total area is 3.18 acres and the sites are currently developed as a commercial retail site (Old Eastside Safeway). The proposed rezoning is in accord and in harmony with the Comprehensive Plan designation of “Urban Mixed Use” given that the proposed use will service the residents of the neighborhood as well as the needs of the region, and is done for the public good; that is, to serve one (1) or more goals of the comprehensive plan and enabling legislation and thereby bear a relationship to the public health, safety or general welfare. FINANCIAL IMPLICATIONS: There are no financial implications for the City. BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission, at their October 9, 2019 Regular Meeting, voted 6-0 (Commissioner Lewis Abstaining) to recommend approval. STAKEHOLDER PROCESS: The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing to all property owners located within 300 feet of the subject property. A Public Notice poster was placed on the subject property 15 days prior to the Public Hearing. ALTERNATIVES: If City Council does not approve this Ordinance, the current zoning would remain. Upon request of City Council, the Ordinance could be returned to the Planning and Zoning Commission for consideration of proposed modifications. RECOMMENDATION: Approval of the Ordinance.
