ORDINANCE NO. 9626
AN ORDINANCE APPROVING THE HYDE PARK
GARDENS FILING 2 SPECIAL AREA PLAN
WHEREAS, a request for a Special Area Plan for Hyde Park Gardens Filing 2 A
Special Area Plan, has been submitted to the Planning and Zoning Commission for
approval pursuant to Section 17-4-29 of the Pueblo Municipal Code; and,
WHEREAS, the Planning and Zoning Commission after a public hearing found and
determined the objectives and requirements of said Section 17-4-29 can and will be met;
and,
WHEREAS, the Planning and Zoning Commission has recommended the approval
of the Special Area Plan for Hyde Park Gardens Filing 2 A Special Area Plan; NOW
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Special Area Plan for:
A parcel of land located in a portion of the South 1/2 of the Northeast 1/4 of
the Northeast 1/4 of Section 27, Township 20 South, Range 65 West of the
6th P.M. in the County of Pueblo and State of Colorado, being more
particularly described as follows.
Lot 8 in Block 2 of HYDE PARK GARDENS, A SPECIAL AREA PLAN as
filed for record on March 2, 2001 at Reception No. 1371966 in the Records
of Pueblo County Recorder, City of Pueblo, County of Pueblo, State of
Colorado.
Containing 0.54 acres, more or less
attached hereto, is hereby approved.
SECTION 2.
The Special Area Plan is approved without conditions.

SECTION 3.
This Ordinance shall become effective on the date of final action by the Mayor and
City Council.

SUBJECT: AN ORDINANCE APPROVING THE HYDE PARK GARDENS FILING 2
SPECIAL AREA PLAN
SUMMARY:
This Ordinance creates a Special Area Plan of approximately .54 acres including four (4)
residential lots, created by S-19-07 Hyde Park Gardens Filing 2. The Special Area Plan
th
site is generally located north of West 18 Street between Park Avenue and Oak Avenue.
BACKGROUND:
Hyde Park Gardens Filing 2, A Special Area Plan includes four (4) residential lots created
from of Lot 8, Block 2 of Hyde Park Gardens, 2001. Lot 8 was platted as one large .54-
acre parcel to house a FAA beacon. The beacon is no longer at this location.
NeighborWorks is pursuing this resubdivision to facilitate residential development. The
proposed Special Area Plan will allow the development of four residential lots in a
development pattern similar to the existing special area plan which encompasses all
adjacent land north of West 18th Street.
FINANCIAL IMPLICATIONS:
None.
BOARD/COMMISSION RECOMMENDATION:
The Planning and Zoning Commission, at their November 13, 2019 Regular Meeting,
voted 7-0 to recommend approval.
STAKEHOLDER PROCESS:
The Planning Department sent out Notice of the Planning and Zoning Commission Public
Hearing to all property owners located within 300 feet of the subject property.
A Public Notice poster was placed on the subject property 15 days prior to the Public
Hearing.
ALTERNATIVES:
If City Council does not approve this Ordinance, the current lots would be subject to the
standard setbacks of the Single Family Residential (R-2 Zone) District which could
impede the applicant’s ability to develop the property.
Upon request of City Council, the Ordinance could be returned to the Planning and Zoning
Commission for consideration of proposed modifications.
RECOMMENDATION:
Approval of the Ordinance.
