AN ORDINANCE APPROVING AN AGREEMENT WITH THE
COLORADO DEPARTMENT OF TRANSPORTATION (CDOT),
ACCEPTING A GRANT FROM THE FEDERAL HIGHWAY
ADMINISTRATION (FHWA) IN THE AMOUNT OF $418,701, AND
BUDGETING AND APPROPRIATING THE GRANT FUNDS INTO
FINANCE PROJECT ACCOUNT NO. HU1802 – MEL HARMON
DRIVE BRIDGE OVERLAY AND REHABILITATION
WHEREAS, the City and CDOT must enter into an intergovernmental agreement
(Agreement) to administer a construction contract to perform the necessary bridge
repairs, a copy of which is attached and has been approved as to form by the City
Attorney, and;
WHEREAS, the City has been approved to receive funding in the amount of
$418,701 from a Federal Highway Administration (FHWA) grant to rehabilitate the Mel
Harmon Drive Bridge, and;
WHEREAS, the City must furnish a 20% local agency match for said grant in the
amount of $104,675 plus consulting fees for design and project engineering, for a
maximum combined total amount (grant plus match plus consulting fees) of $868,701,
and;
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Intergovernmental Agreement between the City and CDOT for the Mel
Harmon Bridge Rehab, a copy of which is attached hereto and incorporated herein by
this reference and having been approved as to form by the City Attorney, is hereby
approved. The Mayor is authorized to execute and deliver the Agreement in the name of
the City and the City Clerk is directed to affix the seal of the City thereto and attest
same. is hereby approved.
SECTION 2.
The FHWA grant funds in the amount of $418,701 are hereby budgeted and
appropriated and shall be deposited in Capital Project No HU1802 – Mel Harmon Drive
Bridge Overlay and Rehabilitation.
SECTION 3.
The officers and staff of the City are directed and authorized to perform any and
all acts consistent with the intent of this Ordinance to effectuate the policies and
procedures described herein.
SECTION 4.
This Ordinance shall become effective on the date of final action by the Mayor
and City Council

AN ORDINANCE APPROVING AN AGREEMENT WITH THE COLORADO

HARMON DRIVE BRIDGE OVERLAY AND REHABILITATION
SUMMARY:
Attached is an Ordinance entering into an agreement with CDOT, accepting grant funds from
FHWA, and appropriating those funds into finance project account No. HU1802 – Mel Harmon
Drive Bridge Overlay and Rehabilitation.
PREVIOUS COUNCIL ACTION:
Ordinance 9205 (November 27, 2017) adopted the City of Pueblo 2018 Budget, which budgeted
$150,000 for Mel Harmon Drive Bridge Overlay and Rehabilitation project (HU1802). Ordinance
9373 (November 26, 2018) adopted the City of Pueblo 2019 Budget, which budgeted an
additional $300,000 for the same project.
BACKGROUND:
The Mel Harmon Drive Bridge was constructed in 1976. It spans Pueblo Mall Drive and Union
Pacific Railroad Tracks. Recent Bridge Inspection Reports have recommended that
rehabilitation shall include the following tasks to preserve the structure: resurface the bridge
deck, address settlement issues/mud jack slope pavement, remove and replace noncompliant
bridge railing, modify approach rails, remove and replace damaged curb and gutter and
sidewalk, remove vegetation, etc.
In 2018, the City was awarded a grant from the FHWA in the amount of $418,701 to aid in the
rehabilitation of this bridge. The source of the funds that were budgeted and appropriated in the
2018 and 2019 City of Pueblo annual budget is the FASTER Bill portion of the City’s Highway
User Tax Fund (HUTF).
FINANCIAL IMPLICATIONS:
The required $104,675 local agency match, as well as design engineering fees and project
engineering fees will come from the established project fund HU1802, as approved by the 2018
and 2019 City of Pueblo Budget reports.
The total Project budget, HU1802 will be funded through the following sources:
2018 City of Pueblo Budget (HUTF- FASTER) HU1802 $150,000
2019 City of Pueblo Budget (HUTF- FASTER) HU1802 $350,000
FHWA Grant $418,701
Total $868,701

ALTERNATIVES:
If the proposed Ordinance is not approved, the bridge will not be repaired at this time, further
deterioration of the structure may occur. Furthermore, if the City does not complete this project
within the allotted time period mandated by CDOT, the City will lose the grant funds.
