AN ORDINANCE ACCEPTING THE DONATION OF REAL
PROPERTY AND A SCULPTURE IN HONOR OF RENOWNED
PUEBLOAN WALLACE R. “WALLY” STEALEY
WHEREAS, Wallace Rozell “Wally” Stealey, Ph.D. was born on May 3, 1934 in Ouray,
Colorado and passed away on October 6, 2017 at his home in Pueblo; and
WHEREAS, during his long and productive life, Dr. Stealey had many vocations including
rancher, marine, college professor and lobbyist; and
WHEREAS, Dr. Stealey served in the United States Marine Corps from 1953 to 1956 and
after an honorable discharge from military service, he continued his education at Ft. Lewis Junior
College in Durango and later received a Bachelor of Arts Degree from Westminster College in
Salt Lake City; a Masters Degree from Western State College in Gunnison and in 1983 he was
awarded a Doctoral Degree from the University of Colorado; and
WHEREAS, Dr. Stealey was a renowned professor of political science and constitutional
law at the Southern Colorado State College (now known as Colorado State University – Pueblo);
and
WHEREAS, because of his legal and political acumen, in 1975 Dr. Stealey was hired by
Governor Richard Lamm to be the state’s lobbyist in the Colorado Legislature; and
WHEREAS, Dr. Stealey was the successful campaign manager of Puebloans J.D.
MacFarlane who became Colorado’s Attorney General and Ray Kogovsek who served three
terms in the U.S. Congress; and
WHEREAS, throughout his distinguished career in public service, Dr. Stealey was a
tireless advocate for the City of Pueblo, Pueblo County and rural Colorado. NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The City of Pueblo hereby accepts the donation of real property and a sculpture in honor
of renowned Puebloan, Wallace R. “Wally” Stealey.
SECTION 2.
The officers and staff of the City are authorized and directed to perform any and all acts
consistent this Ordinance which are necessary or appropriate to implement the transactions
described therein.
SECTION 3.
This Ordinance shall become effective on the date of final action by the Mayor and City
Council.

Final adoption of Ordinance by City Council on December 9, 2019 .

SUMMARY:
Attached is an Ordinance accepting the donation of real property and a sculpture from Sharon
Stealey, in honor of late husband, Wallace R. “Wally” Stealey.
PREVIOUS COUNCIL ACTION:
Not applicable to this Ordinance.
BACKGROUND:
The attached Ordinance accepts the donation of a land parcel located at 301 S. Union Avenue,
Pueblo, Colorado 81003 and a bronze sculpture of renowned Puebloan Wallace R. “Wally”
Stealey.
FINANCIAL IMPLICATIONS:
Sharon Stealey is making the donation of the land and sculpture at no cost to the City. The
improved value of the parcel is estimated to be $137,920.24.
BOARD/COMMISSION RECOMMENDATION:
Not applicable to this Ordinance.
STAKEHOLDER PROCESS:
Not applicable to this Ordinance.
ALTERNATIVES:
If this Ordinance is not approved, the City will not accept Ms. Stealey’s donation of land, bronze
sculpture and landscaping improvements.
RECOMMENDATION:
Approve the Ordinance.

GENERAL WARRANTY DEED
THIS DEED is dated this iv ti day of'9 e r , 2019 and is made between Sharon
Stealey, the "Grantor," whose legal address is 1190 43rd Lane, Pueblo, CO 81006 and the City of
Pueblo, Colorado, a Colorado municipal corporation,the"Grantee," whose legal address is 1 City Hall
Place, Pueblo, Colorado 81003.
WITNESS, that the Grantor, for and in consideration of the sum of Ten Dollars and other good
and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, has granted,
bargained, sold, and conveyed, and by these presents does grant, bargain, sell, convey, and confirm,
unto Grantee and Grantee's heirs, successors, and assigns forever, all the real property, together with
any improvements thereon, located in the County of Pueblo and State of Colorado, described in Exhibit
A, attached hereto and incorporated herein by this reference.
TOGETHER with all and singular the hereditaments and appurtenances thereunto belonging, or
in anywise appertaining,the reversions, remainders, rents, issues and profits thereof, and all the estate,
right, title, interest, claim and demand whatsoever of the Grantor, either in law or equity, of, in and to
the above bargained premises, with the hereditaments and appurtenances.
TO HAVE AND TO HOLD the said premises above bargained and described, with the
improvements, hereditaments and appurtenances, unto the Grantee and the Grantee's heirs and assigns
forever. The Grantor, for itself and its successors and assigns, does covenant and agree that the Grantor
shall and will WARRANT THE TITLE AND DEFEND the above described premises, in the quiet
and peaceable possession of the Grantee and the heirs and assigns of the Grantee, against all and every
person or persons claiming the whole or any part thereof, by, through or under the Grantors except and
subject to the following matters: taxes and assessments for the year of conveyance and subsequent
years and easements of record.
