A RESOLUTION APPROVING AND ACCEPTING A
WARANTY DEED FROM COLORADO STATE
UNIVERSITY-PUEBLO FOR A PARCEL OF PROPERTY
TOTALING APPROXIMATELY 3.86 ACRES WITHIN THE
COUNTY OF PUEBLO AND STATE OF COLORADO
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Warranty Deed granted by Colorado State University-Pueblo, dated
December 9, 2019,a copy of which is attached hereto, having been approved as to form
by the City Attorney, is hereby approved and accepted.
SECTION 2.
The City Clerk is directed to record the Warranty Deed in the office of the Pueblo
County Clerk and Recorder.
SECTION 3.
The officers and staff of the City are authorized and directed to perform any and
all acts consistent with the intent of this Resolution to implement the policies and
procedures described herein.
SECTION 4.
This Resolution shall become effective immediately upon passage and approval.

SUBJECT: A RESOLUTION APPROVING AND ACCEPTING A WARANTY DEED
FROM COLORADO STATE UNIVERSITY - PUEBLO FOR A PARCEL OF
PROPERTY TOTALING APPROXIMATELY 3.86 ACRES WITHIN THE
COUNTY OF PUEBLO AND STATE OF COLORADO
SUMMARY:
The Resolution approves and accepts a warranty deed for a parcel of property totaling
3.86 acres of unsubdivided land for public access purposes located in the SE ¼ of Section
th
8 and NE ¼ of Section 17, Township 20 South, Range 64 West of the 6 P.M. in the
County of Pueblo and State of Colorado.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
This portion of unsubdivided land contains approximately 3.86 acres is being deeded to
the City for the future development of Walking Stick Boulevard. The portion of land
stretches between the subdivisions of The Village Green at Walking Stick Vista Filing No.
2, 2007, and Walking Stick Vista Filing No. 1, 2008, and is dedicated for public access.
With the development of Walking Stick Boulevard, access to the Walking Stick Vista Filing
1 subdivision would be improved and would bring the Boulevard closer to connection with
the residential developments to the north of Walking Stick Golf Course. This could
facilitate further development in the area and improve automobile circulation. The
alignment of Walking Stick Boulevard through Parcel 1 of Walking Stick Vista Subdivision
has not yet been determined. This Resolution approves the City of Pueblo’s acceptance
of the warranty deed for the property.
FINANCIAL IMPLICATIONS:
The City will be responsible for the maintenance of the property, and when constructed,
the maintenance of Walking Stick Boulevard.
BOARD/COMMISSION RECOMMENDATION:
The Planning and Zoning Commission recommended approval of the Village Green at
Walking Stick Vista Subdivision, Filing 2 on May 10, 2006 which included the alignment
for Walking Stick Boulevard up to the southern boundary of the current subject property.
ALTERNATIVES:
If the Resolution is not approved, the property will not be accepted by the City and the
section of Walking Stick Boulevard will not be constructed within this section of property.
RECOMMENDATION:
Approval of the Resolution.

GENERAL WARRANTY DEED
THIS DEED is dated this .1" day of L, 04,4 , 20 i" and is made between The Board of
Governors of the Colorado State University System acting by and through Colorado State University-Pueblo,
the "Grantor," whose legal address is 2200 Bonforte Blvd., Pueblo, Colorado 81001 and the City of Pueblo,
Colorado, a Colorado municipal corporation, the "Grantee," whose legal address is 1 City Hall Place, Pueblo,
Colorado 81003.
WITNESS, that the Grantors, for and in consideration of the sum of Ten Dollars and other good and
valuable consideration, the receipt and sufficiency of which is hereby acknowledged, has granted, bargained,
sold, and conveyed, and by these presents does grant, bargain, sell, convey, and confirm, unto Grantee and
Grantee's heirs, successors,and assigns forever, all the real property,together with any improvements thereon,
located in the County of Pueblo and State of Colorado,described as follows:

TOGETHER with all and singular the hereditaments and appurtenances thereunto belonging, or in
anywise appertaining,the reversions, remainders, rents, issues and profits thereof, and all the estate,right,title,
interest, claim and demand whatsoever of the Grantor, either in law or equity,of, in and to the above bargained
premises, with the hereditaments and appurtenances.
TO HAVE AND TO HOLD the said premises above bargained and described, with the improvements,
hereditaments and appurtenances, unto the Grantee and the Grantee's heirs and assigns forever. The Grantor,
for itself and its successors and assigns, does covenant and agree that the Grantor shall and will WARRANT
THE TITLE AND DEFEND the above described premises, in the quiet and peaceable possession of the
Grantee and the heirs and assigns of the Grantee, against all and every person or persons claiming the whole or
any part thereof, by, through or under the Grantors except and subject to the following matters: taxes and
assessments for the year of conveyance and subsequent years and easements of record.

A parcel of land located in the SE 1/4 of Section 8 and NE 1/4 of Section 17, Township 20 South,
Range 64 West of the 6th P.M. in the County of Pueblo and State of Colorado and being more
particularly described as follows:
Considering the North line of Section 17, Township 20 South, Range 64 West of the 6th P.M. to
bear N. 88°45'07" E., and all bearings contained herein being relative thereto.
Beginning at the Southeast corner of Walking Stick Boulevard right-of-way as platted in The
Village Green at Walking Stick, Filing No. 2 according to the recorded plat thereof as filed for
record on January 25, 2007 at Reception No. 1711137 in the Pueblo County records; thence N.
42°43'04" W., a distance of 100 feet to the southeasterly corner of Lot 1, Block 1 in said The
