AN ORDINANCE ESTABLISHING CAPITAL PROJECT NO.
SW-1908, BUDGETING AND APPROPRIATING $101,579
TO SAID PROJECT AND AMENDING RESOLUTION NO.
14247
WHEREAS, the City submitted a Subgrant Application to FEMA PU 004-
Fountain Creek Gravel Access Road Washout to repair damage caused by heavy rains
received from May 4, 2015 thru June 16, 2015; and
WHEREAS, FEMA approved the application and shall reimburse the Stormwater
Utility Enterprise seventy-five percent of the project costs; and
WHEREAS, the anticipated costs of the project is $101,579; NOW,
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
Capital Project No. SW1908 is hereby established. Funds in the amount of
$101,579 shall be budgeted and appropriated to Capital Project No. SW1908
representing $76,184.25 of FEMA funds and funds in the amount $25,394.75 which is
hereby transferred from Stormwater Unreserved Fund Balance.
SECTION 2.
Section 2 of Resolution No. 14247 is hereby amended to read as follows, “Funds
for Project No. 19-025, Fountain Creek Access Road Repair Project, shall be from
SW1908.”
SECTION 3.
The officers and staff of the City are authorized and directed to perform any and
all acts consistent with the intent of this Ordinance.
SECTION 4.
This Ordinance shall become effective on the date of final action by the Mayor and
City Council.

AN ORDINANCE ESTABLISHING CAPITAL PROJECT NO. SW1908,
BUDGETING AND APPROPRIATING $101,579, TO SAID PROJECT AND
AMENDING RESOLUTION NO. 14247
SUMMARY:
This Ordinance budgets and appropriates $76,184.25 with FEMA relief fund proceeds,
transfers additional $25,394.75 from Stormwater Unreserved Fund Balance and
establishes the SW1908 Fountain Creek Access Road Repair Project.
PREVIOUS COUNCIL ACTION
:
City Council, on November 12, 2018, approved Ordinance 9359 which established Project
SW1704 budgeting and appropriating $493,554 with FEMA relief funds per grant
agreement PW181.
City Council, on July 22, 2019, approved Resolution 14247 which awarded Project No.
19-025 (SW1704), Fountain Creek Access Road Repair project for construction.
BACKGROUND
:
In June of 2015, the Fountain Creek experienced flooding that caused damage along the
Creek including washout of a Fountain Creek maintenance access road and damage to
a pedestrian trail near a recreation/picnic area.
On July 16, 2015, President Obama issued a major disaster declaration for the State of
Colorado that allowed for Federal relief funds through FEMA to repair the pedestrian trail
and access road. FEMA created two projects for these damaged areas along Fountain
Creek: Fountain Creek Gravel Access Road Washout (PW179) and Fountain Creek
Recreation/Picnic Area – PAAP (PW181). City Council approved the establishment of
project SW1704 which included funding for PW181 only. SW1908 needs to be
established to appropriate funding for PW179. Resolution 14247 incorrectly referenced
SW1704. FEMA will reimburse 75% of the actual repair costs for the Fountain Creek
Access Road Repair project to the City of Pueblo.
FINANCIAL IMPLICATIONS
:
$101,579.00 will be budgeted and appropriated, to SW1908 Fountain Creek Access Road
Repair Project. SW1908 will have a total of $101,579.00.

ALTERNATIVES
:
Alternative No. 1 – No Action
Under this alternative, the repair work for Fountain Creek Access Road Repair project
that has already been awarded to a contractor via Resolution 14247 will not be
completed and high water levels in Fountain Creek could possibly overtop the
maintenance access road berm that was washed out and cause flooding to local
residences and businesses.
RECOMMENDATION
:
Approval of the Ordinance.
