AN ORDINANCE APROVING AND RATIFYING THE PRIOR
SIGNATURE OF THE MAYOR, DATED SEPTEMBER 3,
2019 FOR THE LETTER OF COMMITMENT WITH TRANE
US, INC. FOR THE SRDA HVAC ADDITION DESIGN-BUILD
PROJECT AND AUTHORIZING THE MAYOR TO EXECUTE
SAME
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Letter of Commitment between the City of Pueblo, a Colorado Municipal
Corporation, and Trane US, Inc. signed by the Mayor on September 3, 2019, a copy of
which is attached, having been approved as to form by the City Attorney, is hereby
approved and ratified.
SECTION 2.
Funds in the amount of $160,000 are available from Capital Improvement Project
CI1909.
SECTION 3.
The officers and staff of the City are authorized and directed to perform any and
all acts consistent with the intent of the Ordinance and Agreement to implement the
policies and procedures described therein.
SECTION 4.
This Ordinance shall become effective immediately upon final action by the Mayor
and City Council.

LETTER OF COMMITMENT WITH TRANE US, INC. FOR THE SRDA
HVAC ADDITION DESIGN-BUILD PROJECT AND AUTHORIZING THE
MAYOR TO EXECUTE SAME
SUMMARY:
This Ordinance approves and ratifies the prior signature of the Mayor of the Letter of
Commitment (LOC) for the SRDA HVAC Addition Design-Build Project dated September
3, 2019. The City Building Department has determined the HVAC system at the Senior
Resources Development Agency (SRDA) needs replacement and is at risk of failing. Due
to time constraints to submit shovel-ready drawings and cost estimate for the Department
of Local Affairs (DOLA) grant funding by November 27, 2019, the LOC needed to be
signed by the Mayor as soon as possible. Rocky Mountain Trane will be the design-build
contractor through a national master procurement agreement with US Communities.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
The City of Pueblo Building Department has been maintaining and repairing the 1994
HVAC system at SRDA for years. The system is over 5 years past the ASHARE expected
life cycle and is showing signs of failure. The City in partnership with SRDA will submit a
grant application to the Department of Local Affairs (DOLA) on December 2, 2019 for
matching funds for a shovel-ready project for the replacement of the HVAC and an
addition to the back of the SRDA building. The existing equipment is a Trane system. The
City received a Preconstruction Phase Turnkey US Communities Proposal for the design
and construction drawings for the Project. Rocky Mountain Trane is a partner in the US
Communities program to provide these services at a competitive cost through the master
purchase agreement. If the DOLA grant is successful, the City will continue with Trane to
construct the project. The cost of the preconstruction services will be included in the
$1,600,000 estimated cost of the Project. If the DOLA application is not successful, the
City will pay Trane the $160,000 proposal price for the preconstruction phase and will
own the documents. The City will continue with Trane as the funds are available.
FINANCIAL IMPACT:
Funds in the amount of $160,000 shall be available from Capital Improvement Project
CI1909.

ALTERNATIVES:
The Project will not go forward if the Ordinance is not approved.
