ORDINANCE NO. 9538
AN ORDINANCE TRANSFERRING FUNDS IN THE AMOUNT OF
$82,013 FROM THE WILDLIFE PERIMETER FENCE PROJECT
AP1902 TO THE GENERAL FUND
WHEREAS, funds in the amount of $82,013.00 were transferred from the General Fund
for the design of a wildlife perimeter fence at the Pueblo Memorial Airport; and
WHEREAS, these funds may be returned to the General Fund; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
Funds in the amount of $82,013.00 are hereby transferred from the Wildlife Perimeter
Fence Project AP1902 to the General Fund contingent upon the approval of Federal Aviation
Administration Grant No. 3-08-0046-038-2019.
SECTION 2.
The officers and staff of the City are directed and authorized to perform any and all acts
consistent with the intent of this Ordinance to effectuate the transaction described therein.
SECTION 3.
This Ordinance shall become effective on the date of final action by the Mayor and City
Council.

SUMMARY:
This Ordinance returns funds to the General Fund that were used to design the wildlife perimeter
fence project.
PREVIOUS COUNCIL ACTION:
Resolution No. 14238 was approved by the City on October 22, 2018 for the submittal of an
application for Federal Assistance to install a wildlife perimeter fence. On May 28, 2019, the City
approved Ordinance No. 9461 establishing the Wildlife Perimeter Project AP1902, appropriating
and budgeting funds into the project, and approving a contract agreement with Dibble and
Associates to design the project. Council approved an Application for Federal Assistance for
traditional AIP funding on July 8, 2019 by Resolution No. 14238.
BACKGROUND
In order to compete for an FAA AIP grant, the design of the project needed to be funded by the
City. On May 28, 2019, the City approved an Ordinance for funds to be moved into the project for
this purpose. FAA Grant No. 3-08-0046-038-2019 is on this agenda as a separate item for
approval. Ninety-five percent (95%) of the design funds will be reimbursed by the FAA once the
grant is approved.
FINANCIAL IMPLICATIONS:
The City funded the design of the project in the amount of $389,013.00. Most of these funds
came from Airport accounts for the matching funds in the project. However, $82,013 in funds
were transferred from the General Fund into the project. When the project was initially funded,
staff indicated the General Fund portion would be returned once a grant offer was made and
accepted. This ordinance returns those funds, contingent upon the approval of FAA grant.

ALTERNATIVES:
If the FAA grant is not approved, these funds will not be returned to the General Fund.
RECOMMENDATION
The Department of Aviation recommends approval of this ordinance.
