AN ORDINANCE AWARDING A CONSTRUCTION CONTRACT IN
THE AMOUNT OF $3,132,691.75 TO KIRKLAND
CONSTRUCTION, LLLP, FOR SCHEDULE 1 OF PROJECT NO.
19-024 (AP1902) WILDLIFE PERIMETER FENCE PROJECT AT
THE PUEBLO MEMORIAL AIRPORT, AND AUTHORIZING THE
PURCHASING AGENT TO EXECUTE SAME
WHEREAS, proposals for Project No. 19-024 (AP1902) Wildlife Perimeter Fence Project
at the Pueblo Memorial Airport have been received and examined; and
WHEREAS, Kirkland Construction, LLLP, was the lowest and best of those bids
determined to be responsible; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
A contract for Project No. 19-024 (AP1902) Wildlife Perimeter Fence Project at the Pueblo
Memorial Airport is hereby awarded to Kirkland Construction, LLLP, in the amount of
$3,132,691.75.
SECTION 2.
The awarding of this contract is contingent upon the final passage of the Ordinance
accepting the Federal Aviation Administration AIP Grant Agreement No. 3-08-0046-038-2019
(“Grant”).
SECTION 3.
Funds for Project No. 19-024 in the amount of $3,132,691.75 shall be expended from the
Wildlife Perimeter Fence Project No. AP1902.
SECTION 4.
The Purchasing Agent is hereby authorized to execute said contract on behalf of the City
of Pueblo, a Municipal Corporation, and the City Clerk shall affix the Seal of the City thereto and
attest the same.
SECTION 5.
The officers and staff of the City are directed and authorized to perform any and all acts
consistent with the intent of this Ordinance to effectuate the policies and procedures described
therein.
SECTION 6.
This Ordinance shall become effective immediately upon final passage and approval,
contingent upon acceptance of the Grant.

AN ORDINANCE AWARDING A CONSTRUCTION CONTRACT IN THE
SUBJECT:
AMOUNT OF $3,132,691.75 TO KIRKLAND CONSTRUCTION, LLLP,
FOR SCHEDULE 1 OF PROJECT NO. 19-024 (AP1902) WILDLIFE
PERIMETER FENCE PROJECT AT THE PUEBLO MEMORIAL AIRPORT,
AND AUTHORIZING THE PURCHASING AGENT TO EXECUTE SAME
SUMMARY:
Attached is an Ordinance awarding a contract to Kirkland Construction, LLLP for the Wildlife
Perimeter Fence Project at the Pueblo Memorial Airport. The awarding of this contract is
contingent upon the final passage of the Ordinance approving the Federal Aviation Administration
(FAA) AIP Grant Agreement No. 3-08-0046-038-2019.
PREVIOUS COUNCIL ACTION:
On May 28, 2019, Council approved Ordinance No. 9461, which established Project No. AP1902
and approved a contract for design engineering services with Dibble and Associates. On July 8,
2019, Council approved Resolution No. 14238, approving an Application for Federal Assistance
for a traditional Airport Improvement Program (AIP) grant related to the installation of an airport
perimeter wildlife fence.
BACKGROUND
This project will replace the barbed wire fence on the east, north, and west boundaries of PUB
with a wildlife fence to exclude hazardous mammal species as required by the Airport’s Wildlife
Bids for the project were opened on July 30, 2019. A total of

four bids were received. The lowest bid was deemed non-responsive, resulting in the
award to the next lowest bidder.
FINANCIAL IMPLICATIONS:
Funds in the amount of $3,132,691.75 will be expended from the Wildlife Perimeter Fence Project
No. AP1902. The Federal grant will pay for 95% of the contract ($2,976,057). The City will be
responsible for the other 5% ($156,634.75). Due to the timing of this project, the Colorado
Department of Transportation Division of Aeronautics is not participating at this time. However,
they indicated that the City could submit a grant application for up to 2.5% of the project during
its next fiscal year. This application would be due in December 2019.

STAKEHOLDER PROCESS:
Airport staff met with airport stakeholders on May 2, 2019 to discuss this project.
ALTERNATIVES:
If this Ordinance is not approved, the project will not occur.
RECOMMENDATION
The Department of Aviation recommends approval of this ordinance.
