HomeMy WebLinkAbout09534 ORDINANCE NO. 9534 AN ORDINANCE AMENDING CHAPTER 11 OF TITLE XII OF THE PUEBLO MUNICIPAL CODE RELATING TO THE MONTHLY STREET REPAIR UTILITY SERVICE CHARGES FOR THE PUEBLO STREET REPAIR UTILITY ENTERPRISE BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, ACTING IN ITS OWN CAPACITY AND AS THE EX-OFFCIO GOVERNING BODY OF THE CITY OF PUEBLO’S STREET REPAIR UTILITY ENTERPRISE that: (brackets indicate matter being deleted, underscore indicates matter being added) SECTION 1. Section 6 of Chapter 11, Title XII of the Pueblo Municipal Code is hereby amended by the addition of a new Section 6 (f) as follows: Sec. 12-11-6. Determination of street repair utility service charges. (f) The monthly street repair utility service charge is hereby established and shall be computed as follows: Category Monthly Service Charge Residential (Per Dwelling Unit) $ 3.00 Small Service Business $10.00 Retail, Restaurants and Drinking Establishments ˂ $100,000 in $25.00 annual Net Taxable Remittances. Small Retail, Restaurant and Drinking Establishments, Small $50.00 Institutional and Small Industrial (< or = 1 acre) Large Retail, Large Institutional, Large Industrial, and Large Service $100.00 Business (>1 acre) SECTION 2. The officers of the City are authorized and directed to perform any and all acts consistent with this Ordinance to implement the policies and procedures described herein. SECTION 3. This Ordinance shall become effective October 1, 2019. Gradisar SUBJECT: AN ORDINANCE AMENDING CHAPTER 11 OF TITLE XII OF THE PUEBLO MUNICIPAL CODE RELATING TO THE MONTHLY STREET REPAIR UTILITY SERVICE CHARGES FOR THE PUEBLO STREET REPAIR UTILITY ENTERPRISE SUMMARY: This proposed Ordinance amends the Pueblo Municipal Code to adjust the monthly street repair utility service charges beginning October 1, 2019. PREVIOUS COUNCIL ACTION: The Pueblo Street Repair Utility Enterprise (“Enterprise”) was created on December 26, 2017 by Ordinance No. 9217. On May 14, 2018, by Ordinance No. 9278, the City entered into an intergovernmental agreement with the Board of Water Works regarding the billing and collection of the Enterprise’s monthly service fees. On October 9, 2018, by Ordinance No. 9353, Council set the Enterprise’s initial monthly service fees which went into effect February 1, 2019. BACKGROUND: Section 12-11-6 Pueblo’s Municipal Code authorizes City Council, as the ex officio governing board of the Enterprise, to establish monthly street repair utility service charges. This proposed Ordinance adjusts the Enterprise’s monthly service fees as previously set by Council. FINANCIAL IMPLICATIONS: The current rate structure has not produced sufficient revenue to keep up with ongoing street repair needs. City staff recommends a one dollar ($1.00) per month increase in monthly residential rates to remedy this shortfall. In addition, the proposed Ordinance establishes a new street repair rate for retail businesses, including restaurants and drinking establishments, which file City sales tax reports for less than $100,000.00 in annual Net Taxable Remittances. The revised rates are expected to generate annual revenue of approximately $2.9 million in 2020. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: Not applicable to this Ordinance. ALTERNATIVES: A no-action alternative would leave the Enterprise’s current street repair rates in place.
