RESOLUTION NO. 14247
A RESOLUTION AWARDING A CONSTRUCTION CONTRACT IN
THE AMOUNT OF $88,579 TO 53 CORPORATION, LLC, AND
SETTING FORTH $13,000 FOR CONTINGENCIES AND
ADDITIONAL WORK FOR PROJECT NO. 19-025 – FOUNTAIN
CREEK ACCESS ROAD REPAIR PROJECT AND AUTHORIZING
THE PURCHASING AGENT TO EXECUTE THE SAME
WHEREAS, competitive bids for PROJECT NO. 19-025, Fountain Creek Access Road
Repair Project, have been received and examined, and;
WHEREAS, the proposal of 53 CORPORATION, LLC, a Colorado Limited Liability
Company, was the lowest of those bids determined to be responsible, and the Committee of
Awards recommends to the City Council that it authorize PROJECT NO. 19-025 to be performed;
NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
City Council authorizes PROJECT NO. 19-025, Fountain Creek Access Road Repair
Project, to be performed, and the contract for said project is hereby awarded to said bidder in the
amount of $88,579.
SECTION 2.
Funds for PROJECT NO. 19-025, Fountain Creek Access Road Repair Project, shall be
from SW1704.
SECTION 3.
In addition to the amount of the bid set forth, as aforementioned, an additional amount of
$13,000 is hereby authorized for contingencies and additional work.
SECTION 4.
The Purchasing Agent is hereby authorized to execute said contract on behalf of Pueblo,
a Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and attest the
same.
SECTION 5.
The officers and staff of the City are directed and authorized to perform any and all acts
consistent with the intent of this Resolution to effectuate the policies and procedures described
herein.
SECTION 6.
This Resolution shall become effective immediately upon passage and approval.

SUMMARY:
This resolution awards a Construction Contract to 53 Corporation, LLC for the Fountain Creek
Access Road Repair project.
PREVIOUS COUNCIL ACTION:
Resolution #9359. This ordinance budgeted and appropriated the funds for FEMA disaster relief
projects.
BACKGROUND:
In general, this project will consist of bank stabilization and repair of an access road along
Fountain Creek that was damaged as a result of flooding. The work will consist of earthwork (cut
and fill), structural fill, compaction testing, road base installation, revegetation, and other incidental
items related to the construction as detailed in the plans and specifications for this project.
FINANCIAL IMPLICATIONS:
Funding for this project will be paid from funds available for Fountain Creek floodplain and levee
repair. Funding is available and has been budgeted, appropriated, and allocated to Project No.
19-025 (SW1704).

ALTERNATIVES:
Alternative No. 1 - No action
Under this alternative, the access road would remain in a state of disrepair, and since the road
embankment acts as a levee, high water levels in Fountain Creek could cause potential
overtopping and flooding of adjacent properties and public roadways, causing safety hazards,
possible monetary damage, and more costs to repair the damage.
RECOMMENDATION
:
Approval of the Resolution.
