HomeMy WebLinkAbout09480 ORDINANCE NO. 9480 AN ORDINANCE APPROVING A CONTRACT, TAP M086-072 (20192) BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION, AND THE STATE OF COLORADO, THE COLORADO DEPARTMENT OF TRANSPORTATION RELATING TO THE TRAILHEAD AND TRAIL MAINTENANCE AND OPERATION FOR THE ARKANSAS RIVER TRAIL PHASE 4 PROJECT AND AUTHORIZING THE MAYOR TO EXECUTE SAME WHEREAS, the City of Pueblo has entered into Contract TAP M086-072 (20192) with the Colorado Department of Transportation related to the Arkansas River Trail Phase 4 Project; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Contract between the City of Pueblo, a Colorado Municipal Corporation, and the Colorado Department of Transportation for the Trailhead and Trail Maintenance and Operations related to Arkansas River Trail Phase 4, Contract No. TAP M086-072 (20192), a copy of which is attached hereto having been approved as to form by the City Attorney, is hereby approved. SECTION 2. The Mayor is hereby authorized to execute and deliver said Contract in the name of and on behalf of the City of Pueblo, a Colorado Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and attest the same. SECTION 3. The officers and staff of the City are authorized and directed to perform any and all acts consistent with this Ordinance to implement the policies and procedures established herein. SECTION 4. This Ordinance shall become effective immediately upon final passage and approval. Action by City Council: Introduced and initial adoption of Ordinance by City Council on May 28, 2019 . Gradisar, Mayor VIA: Brenda Armijo, Acting City Clerk FROM: Steven Meier, Director of Planning and Community Development SUBJECT: AN ORDINANCE APPROVING A CONTRACT, TAP M086-072 (20192) BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION, AND THE STATE OF COLORADO, THE COLORADO DEPARTMENT OF TRANSPORTATION RELATING TO THE TRAILHEAD AND TRAIL MAINTENANCE AND OPERATION FOR THE ARKANSAS RIVER TRAIL PHASE 4 PROJECT AND AUTHORIZING THE MAYOR TO EXECUTE SAME SUMMARY: This Ordinance approves a Contract between the City of Pueblo and the Colorado Department of Transportation (“CDOT”) for the maintenance and operation of the th trailhead and trail improvements at SH 96 (4 Street) and Arkansas River built as part of the Arkansas River Trail Phase 4 Project. PREVIOUS COUNCIL ACTION: On July 11, 2016, City Council approved the Contract with CDOT related to the Arkansas River Trail Phase 4 Project, Ordinance 9010. BACKGROUND: The Contract for the maintenance and operation of the trailhead and trail improvements th at SH 96 (4 street) and Arkansas River is a requirement of CDOT for the use of grant funds. According to Exhibit A – Scope of Work, the City of Pueblo as the Local Agency is responsible for the maintenance of the new roadway, parking lot, concrete sidewalks, curb and gutter, stormwater system, trash and graffiti removal and the landscape and irrigation. CDOT responsibilities will be to allow access for the City to maintain the CDOT right of way and this Contract will act as the access permit. FINANCIAL IMPLICATIONS: The funds for the maintenance for this Contract will be the responsibility of the City. BOARD/COMMISSION RECOMMENDATION: Not Applicable. STAKEHOLDER PROCESS: Not Applicable.
