HomeMy WebLinkAbout09466ORDINANCE NO.9466 AN ORDINANCE AMENDING ZONING RESTRICTIONS FOR PROPERTY COMMONLY KNOWN AS 1101 EAST ABRIENDO BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering the following described property and generally identified in the attached Rezone Exhibit, is hereby changed from B-2, Subregional Business District to CCN, Commercial Charter Neighborhood: Lots 42 through 46, Block 39, City Hall Place, located within a portion of the SW ¼ of Section 1, Township 21 South, Range 65 West of the Sixth Principal Meridian, Pueblo County, Colorado. SECTION 2. The officers and staff of the City are authorized and directed to perform any and all acts consistent with the intent of the Ordinance to implement the policies and procedures described herein. SECTION 3. This Ordinance shall become effective immediately upon final action by the Mayor and City Council. Gradisar, Mayor VIA: Brenda Armijo, Acting City Clerk FROM: Steven Meier, Director of Planning and Community Development SUBJECT: AN ORDINANCE AMENDING ZONING RESTRICTIONS FOR PROPERTY COMMONLY KNOWN AS 1101 EAST ABRIENDO SUMMARY: The applicant is requesting to rezone the subject property from B-2, Subregional Business District to CCN, Commercial Charter Neighborhood. PREVIOUS COUNCIL ACTION: None. BACKGROUND: The subject area is approximately .35 acres and is located at the south-west corner of Arroyo Avenue and East Abriendo Avenue. The property located at 1101 East Abriendo has historically operated as an automobile fueling and service station.  1932 Texas CO (Texaco)  1958 Abriendo Service Station  1968 Farmer’s Service Station  1978-2006 Robert’s Front End Service The site has remained vacant since the closing of Robert’s Front End Service in 2006. The applicants, Mr. Zetnick and Mr. Davis, purchased the property to redevelop the site with a residence and café. Since their purchase of the property, the applicants have demolished the dilapidated structures along the west property line and have been working on environmental remediation of the property. The historic fueling station structure, located along the north-east corner of the property, remains and will be redeveloped into the proposed café. The applicants plan to construct a single-family residence along the western property line; following the same development pattern that existed previously on site. The remaining portion of the site will be dedicated to gardens and other outdoor living areas. FINANCIAL IMPLICATIONS: There are no financial implications for the City. BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission, at their April 10, 2019 Regular Meeting, voted 6- 0 (Bailey absent) to recommend approval. STAKEHOLDER PROCESS: The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing to all property owners located within 300 feet of the subject property. A Public Notice poster was placed on the subject property 15 days prior to the Public Hearing. ALTERNATIVES: If City Council does not approve this Ordinance, the current zoning would remain. Upon request of City Council, the Ordinance could be returned to the Planning and Zoning Commission for consideration of proposed modifications. RECOMMENDATION: Approval of the Ordinance.
