HomeMy WebLinkAbout09461ORDINANCE NO. 9461 AN ORDINANCE ESTABLISHING THE AIRPORT WILDLIFE FENCE PROJECT NO. AP1902, BUDGETING AND APPROPRIATING $389,013 TO PROJECT NO. AP1902, AND APPROVING A CONTRACT BETWEEN THE CITY OF PUEBLO, A MUNICIPAL CORPORATION, AND DIBBLE AND ASSOCIATES CONSULTING ENGINEERS, INC., AN ARIZONA CORPORATION, TO PROVIDE ENGINEERING SERVICES FOR SAID PROJECT AND AUTHORIZING THE MAYOR TO EXECUTE SAME WHEREAS, a need exists at the Pueblo Memorial Airport for a wildlife fence; and WHEREAS, engineering services are required to design the project; and WHEREAS, Capital Project AP1902 – Wildlife Perimeter Fence needs to be established and funds budgeted and appropriated; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Capital Project No. AP1902 – Wildlife Perimeter Fence is hereby established. SECTION 2. Funds in the amounts of $147,000.00 from Grant Matches – Airport Project No. CIAN18 shall be transferred into Capital Project No. AP1902, $160,000.00 from the Passenger Facilities Fund shall be transferred into Capital Project No. AP1902, and $82,013.00 from the City General Fund Balance shall be transferred into Capital Project No. AP1902. SECTION 3. Funds in the amount of $389,013.00 are hereby budgeted and appropriated to Capital Project No. AP1902 – Wildlife Perimeter Fence. SECTION 4. The contract for professional engineering services with Dibble and Associates Consulting Engineers, Inc., an Arizona Corporation, dba Dibble Engineering, is hereby approved and authorized to be signed by the Mayor. SECTION 5. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Ordinance to effectuate the policies and procedures described therein. SECTION 6. This Ordinance shall become effective on the date of final action by the Mayor and City Council. AP1902, BUDGETING AND APPROPRIATING $389,013 TO PROJECT NO. AP1902, AND APPROVING A CONTRACT BETWEEN THE CITY OF PUEBLO, A MUNICIPAL CORPORATION, AND DIBBLE AND ASSOCIATES CONSULTING ENGINEERS, INC., AN ARIZONA CORPORATION, TO PROVIDE ENGINEERING SERVICES FOR SAID PROJECT AND AUTHORIZING THE MAYOR TO EXECUTE SAME SUMMARY: This ordinance establishes Project No. AP1902, appropriates $389,013.00 to said Project, and approves a contract to design a wildlife perimeter fence and associated storm water structures, to accommodate Federal Aviation Administration requirements regarding wildlife on and near the Pueblo Memorial Airport. PREVIOUS COUNCIL ACTION: Council approved an application for Federal Assistance for installation of wildlife fencing on October 22, 2018. BACKGROUND The Federal Aviation Administration (FAA) funded an Airport Improvement Program (AIP) grant to conduct a Wildlife Hazard Assessment at the Pueblo Memorial Airport (PUB). This Wildlife Hazard Assessment indicated that wildlife presented a safety hazard to the operation of aircraft and that a Wildlife Hazard Management Plan be written for PUB. This was completed and has been followed in the intervening years. A requirement of the plan is to replace the barbed wire fence on the east, north, and west boundaries of PUB with a wildlife fence to exclude hazardous mammal species. This is a capital-intensive project for which funding has not been available. In the fall of 2018, an application was submitted to the FAA to install the wildlife fence as part of the Consolidated Appropriations Act, 2018, which appropriated additional money for AIP eligible projects. The FAA has indicated that the wildlife fence project will not receive money under this program. However, they have indicated that if PUB is able to design the project, it is high on the priority list to fund in Federal Fiscal Year 2019 or Federal Fiscal Year 2020, as discretionary funds may allow. FINANCIAL IMPLICATIONS: The City must fund the design of the project upfront with an expected grant to come. There is $147,000.00 available in the Capital Grant Matches Account – CIAN18, $160,000.00 available in the Passenger Facility Charge Fund, and $82,013.00 will be contributed from the City General Fund Balance. This provides for a total of $389,013.00 to fund the design fee. It is anticipated that 95% of these funds will be reimbursed by the Federal Aviation Administration through an AIP grant. This is expected as early as the end of Federal Fiscal Year 2019 or in Federal Fiscal Year 2020. BOARD/COMMISSION RECOMMENDATION: Not applicable. STAKEHOLDER PROCESS: Airport staff met with airport stakeholders on May 2, 2019 to discuss this project. ALTERNATIVES: If this agreement is not approved, the project will not be undertaken. Funding in future years will be used to complete this project rather than for other beneficial projects. RECOMMENDATION The Department of Aviation recommends approval of this ordinance.
