A RESOLUTION APPROVING AND RATIFYING
THE
FILING OF AN APPLICATION FOR A COLORADO GRAY
AND BLACK MARKET MARIJUANA ENFORCEMENT
GRANT BY THE CITY OF PUEBLO, A MUNICIPAL
FROM THE COLORADO DEPARTMENT
CORPORATION
OF LOCAL AFFAIRS RELATING TO THE
INVESTIGATION AND PROSECUTION OF UNLICENSED
MARIJUANA CULTIVATION AND DISTRIBUTION
OPERATIONS
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The submission of an application for the 2019 Gray and Black Market Marijuana
Enforcement Grant, performed on March 26, 2019, is hereby approved and ratified.
SECTION 2.
The officers and staff of the City are authorized and directed to perform any and
all acts consistent with the intent of this Resolution to effectuate the policies and
procedures described therein.
SECTION 3.
This Resolution shall become effective immediately upon final passage.

A RESOLUTION APPROVING AND RATIFYING THE FILING OF AN
APPLICATION FOR A COLORADO GRAY AND BLACK MARKET
MARIJUANA ENFORCEMENT GRANT BY THE CITY OF PUEBLO, A
MUNICIPAL CORPORATION FROM THE COLORADO DEPARTMENT
OF LOCAL AFFAIRS RELATING TO THE INVESTIGATION AND
PROSECUTION OF UNLICENSED MARIJUANA CULTIVATION AND
DISTRIBUTION OPERATIONS
SUMMARY:
This Resolution ratifies an application for the Gray and Black Market Marijuana
Enforcement Grant Program. The purpose of this grant is to provide financial assistance
grants annually to local law enforcement agencies and district attorneys through the local
governments for the investigation and prosecution costs associated with unlicensed
marijuana cultivation or distribution operations.
PREVIOUS COUNCIL ACTION:
None. This is the first time the City has applied for this grant.
BACKGROUND:
The legalization of marijuana has created a problem with the illegal growing and
cultivation of marijuana in rural areas such as Pueblo. The Police Department has
investigated 12 operations within City limits in the last 3 months. If the City of Pueblo is
chosen as a recipient, the Gray and Black Market Marijuana Enforcement Grant Program
will provide funding to assist in the investigation of such grows.
FINANCIAL IMPLICATIONS:
This grant will require monitoring, auditing, and submission of financial documents which
will impact the City with staffing costs. The grant does provide monies to offset those
expenditures. The grant directs that funds can only be used for costs associated with the
investigation and prosecution (including large-scale operations, organized crime, and
operations that divert marijuana outside of Colorado) of unlicensed marijuana cultivation
or distribution operations conducted in violation of state law. Recipient counties and
municipalities who spend any grant funds outside of this statutory intent understand that
any such funds must be returned to the Department of Local Affairs and agree to do so
within 30 days of identification of improper fund use.
Matching funds from the City are not required for this grant.
BOARD/COMMISSION RECOMMENDATION:
None.
STAKEHOLDER PROCESS:
The Pueblo Police Department Special Investigations Division, Narcotics unit is seeking
funds from Gray and Black Market Marijuana Enforcement Grant Program. They are
requesting support from the City of Pueblo to help obtain approval of the grant. This
resolution approving the filing of a grant application is the first step in the process.
ALTERNATIVES:
If City Council does not approve this Resolution, the Special Investigations Division will
not receive funds to help with future investigations into the illegal growing and cultivation
of marijuana in the City of Pueblo.
RECOMMENDATION:
Approval of the Resolution.
