HomeMy WebLinkAbout14182RESOLUTION NO. 14182 A RESOLUTION DESIGNATING THE MAYOR AS THE AUTHORIZED REPRESENTATIVE TO EXECUTE APPLICATIONS WITH THE FEDERAL TRANSIT ADMINISTRATION FOR FEDERAL TRANSPORTATION ASSISTANCE AUTHORIZED BY CHAPTER 53 OF TITLE 49 OF THE UNITED STATES CODE AND ANY OTHER FEDERAL STATUTES ADMINISTERED BY THE FEDERAL TRANSIT ADMINISTRATION WHEREAS, the Federal Transit Administration has been authorized to provide funding to support public transportation under 49 U.S.C. Chapter 53; and WHEREAS, grants or cooperative agreements for Federal financial assistance will impose certain obligations upon the City of Pueblo, a Colorado municipal corporation (“City”), and may require City to provide the non-Federal share of transportation-related expenses supported with Federal financial assistance; and WHEREAS, City is legally authorized under Federal, state, or local law to apply for and receive Federal assistance; and WHEREAS, City is the Designated Recipient as defined at 49 U.S.C. 5307(a) (2) to apply for and receive Urbanized Area Formula Program assistance authorized by 49 U.S.C. 5307; and WHEREAS, City is required to provide certain certifications and assurances to the Federal Transit Administration at least annually; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Mayor is the designated official authorized to execute and file an application for Federal assistance approved by City Council and on behalf of City with the Federal Transit Administration for Federal assistance authorized by 49 U.S.C. Chapter 53 or any other Federal statutes authorizing activities administered by the Federal Transit Administration. SECTION 2. The Mayor is the designated official authorized to execute and file with the Federal Transit Administration the annual certifications and assurances and other documents the Federal Transit Administration requires before awarding a Federal assistance grant or cooperative agreement. SECTION 3. The Mayor is the designated official authorized to execute the grant and cooperative agreements with the Federal Transit Administration approved by City Council on behalf of City. SECTION 4. The Mayor or designee is the designated official(s) authorized to draw payments against available grant funding using the ECHO web system or other Federal Transit Administration automated applications used to request payments from grant awards. SECTION 5. This Resolution shall become effective immediately upon final passage. Jagger for and on behalf of Ben Valdez, Interim Transit Director SUBJECT: A RESOLUTION DESIGNATING THE MAYOR AS THE AUTHORIZED REPRESENTATIVE TO EXECUTE APPLICATIONS WITH THE FEDERAL TRANSIT ADMINISTRATION FOR FEDERAL TRANSPORTATION ASSISTANCE AUTHORIZED BY CHAPTER 53 OF TITLE 49 OF THE UNITED STATES CODE AND ANY OTHER FEDERAL STATUTES ADMINISTERED BY THE FEDERAL TRANSIT ADMINISTRATION SUMMARY: Attached for consideration is a Resolution designating the Mayor as the authorized representative to execute applications for Federal Transportation Assistance grants administered by the Federal Transit Administration. PREVIOUS COUNCIL ACTION: Authorizing Resolution No. 5687 passed August 25, 1986. Resolution No. 13804 passed October 23, 2017. BACKGROUND: Certifications and Assurances must be executed by the City’s authorized representative. The authority of the authorized representative to make certifications on behalf of the City must be approved by a resolution in accordance with requirements of the Federal Transit Administration. If the City’s authorized representative changes, the City should pass and approve a new resolution identifying the new authorized representative. With the change to the Mayor-Council form of government, the Mayor would now be the authorized representative to sign the applications and the certifications and assurances. § 1-4-3, P.M.C. As such, a new resolution must be approved in accordance with requirements of the Federal Transit Administration. FINANCIAL IMPLICATIONS: There are no financial obligations with this Resolution. BOARD/COMMISSION RECOMMENDATION: Not applicable. STAKEHOLDER PROCESS: Not applicable. ALTERNATIVES: If City Council does not approve this Resolution, the City of Pueblo will not be authorized to submit grant applications for operating funds or capital equipment.
