HomeMy WebLinkAbout09434 ORDINANCE NO. 9434 AN ORDINANCE APPROVING AN AGREEMENT IN THE AMOUNT OF $294,773 BETWEEN THE CITY OF PUEBLO AND BROWN AND CALDWELL FOR PROFESSIONAL SERVICES ASSOCIATED WITH UPDATING THE SANITARY SEWER MASTER PLAN FOR THE CITY OF PUEBLO WHEREAS, the City of Pueblo owns, operates and maintains a wastewater system subject to the requirements of the Federal Clean Water Act and the Colorado Water Quality Control Act; and WHEREAS, the Colorado Department of Public Health and Environment requires the sanitary sewer collection system to be properly maintained and operated under the Colorado Discharge Permit for the James R. DiIorio Water Reclamation Facility; and WHEREAS, Brown and Caldwell, Inc is the Engineer of Record for the City of Pueblo Wastewater Department, they will provide professional services for updating the Sanitary Sewer Master Plan for the City of Pueblo; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Agreement for Professional Services by and between Pueblo, a Municipal Corporation, and Brown and Caldwell, Inc., a true copy of which is attached hereto and incorporated herein by reference (the “Agreement”) having been approved as to form by the City Attorney, is hereby approved. SECTION 2. Funds for payment for professional services under said Agreement in an amount not to exceed $294,773 shall be paid from appropriated funds budgeted in the City’s 2019 Budget from the Sewer User Fund Project No. WW1503. SECTION 3. The Mayor is hereby authorized to execute said contract on behalf of Pueblo, A Municipal Corporation, and the Acting City Clerk shall affix the seal of the City thereto and attest the same. SECTION 4. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Ordinance and the attached agreement to effectuate the transactions described therein. SECTION 5. This Ordinance shall become effective on the date of final action by the Mayor and City Council. Gradisar, Mayor VIA: Brenda Armijo, Acting City Clerk FROM: Nancy Keller, Wastewater Director SUBJECT: AN ORDINANCE APPROVING AN AGREEMENT IN THE AMOUNT OF $294,773 BETWEEN THE CITY OF PUEBLO AND BROWN AND CALDWELL FOR PROFESSIONAL SERVICES ASSOCIATED WITH UPDATING THE SANITARY SEWER MASTER PLAN FOR THE CITY OF PUEBLO SUMMARY: This Ordinance accepts an agreement between the City and our Engineer of Record, Brown and Caldwell, Inc to provide professional services to upgrade the Sanitary Sewer Master Plan for the City of Pueblo and provide a hydraulic model. PREVIOUS COUNCIL ACTION : Resolution No. 14081 awarded an agreement between the City of Pueblo and Brown and Caldwell, Inc., to provide engineering services for the Pueblo Wastewater Department, on November 12, 2018. BACKGROUND : New developments along the boundaries of the existing Pueblo city limits is driving the extension of the sanitary sewer collection system, as well as internal developments increasing the upsizing needs within the existing sanitary sewer system. An updated master plan is needed to assure orderly and efficient development of the sanitary sewer system. The City’s existing sanitary sewer master plan was prepared in 2009 but significant issues have been found that were not addressed in that update. Technology has improved since that time allowing better measurement and recording of the collection system parameters, but the datum that the city’s reference point for elevation was based on has changed over the years causing inconsistencies in elevation data. The master plan project will review the existing sanitary sewer system, identify hydraulic bottlenecks, review land use and demographic data to project growth areas, correct datum discrepancies when possible and develop a computer flow model to aid in future collection system planning based on current data. FINANCIAL IMPLICATIONS : The cost of the agreement is not to exceed a price of $294,773. Funds are available from the Sewer User Funds and have been budgeted and appropriated to WW1503. BOARD/COMMISSION RECOMMENDATION : Not applicable STAKEHOLDER PROCESS : None ALTERNATIVES : As new developments occur the city can allow the developer to attach to existing infrastructure without requiring them to pay for the impact of the increased flow. When the development begins to impact the collection system, the rates would have to be increased to pay for upgrades to the collection system in that area. RECOMMENDATION : Approval of the Ordinance. Attachments : The agreement for Professional Services between the City of Pueblo and Brown and Caldwell, Inc. and a copy of the Scope of Work is attached.
