AN ORDINANCE APPROVING A FIRST AMENDMENT TO A
PROFESSIONAL ARCHITECTURAL SERVICES AGREEMENT
BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL
CORPORATION, AND HORD COPLAN MACHT ARCHITECTS
INC., A MARYLAND CORPORATION, RELATING TO THE
GOODNIGHT BARN RESTORATION PROJECT AND
AUTHORIZING THE MAYOR TO EXECUTE SAID AMENDMENT
WHEREAS, Hord Coplan Macht Architects, Inc. has been selected to provide professional
services for the Goodnight Barn Restoration Project; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The First Amendment dated February 25, 2019, to the Agreement for Professional
Architectural Services, between the City of Pueblo, a Colorado Municipal Corporation, and Hord
Coplan Macht Architects, Inc., a Maryland Corporation, a copy of which is attached hereto and
having been approved as to form by the City Attorney, is hereby approved.
SECTION 2.
The Mayor is hereby authorized to execute and deliver said First Amendment on behalf
of the City of Pueblo, and the Acting City Clerk shall affix the Seal of the City thereto and attest
same.
SECTION 3.
Funds in the amount of $10,580 for said professional services agreed to in the First
Amendment, shall be paid from Capital Project PL1704.
SECTION 4.
The officers and staff of the City are authorized and directed to perform any and all acts
consistent with this Ordinance and the attached First Amendment, to implement the policies and
procedures described herein.
SECTION 5.
This Ordinance shall become effective on the date of final action by the Mayor and City Council.

SUMMARY:
This Ordinance approves a first amendment to an agreement for professional architectural
services to include additional electrical and civil engineering services required to prepare
electrical plans and a site plan for the Goodnight Barn Restoration Project. The funds for the
additional professional services have been budgeted in the Capital Project, PL1704.
PREVIOUS COUNCIL ACTION:
On November 27, 2017 the Pueblo City Council approved an agreement for architectural
services and construction management for the restoration project to Hord Coplan Macht
Architects, Inc. (HCM) by Resolution No. 13826.
BACKGROUND:
The City of Pueblo has completed the emergency stabilization of the Goodnight Barn. The
architectural services for the restoration construction documents and bidding and construction
management services have been completed by HCM Architects, Inc. Since the award of
additional funds from the Department of Local Affairs, the amendment to the agreement will
allow the City to utilize HCM Architects, Inc. to provide professional services for the electrical
services and development of a site plan for the Project.
FINANCIAL IMPLICATIONS:
Funds in the amount of $10,580 shall be paid from Capital Project No. PL1704 to accomplish
the scope of work agreed to in the First Amendment.
BOARD/COMMISSION RECOMMENDATION:
Not applicable.
STAKEHOLDER PROCESS:
The Goodnight Barn Stakeholders have strongly recommended funding for the restoration.
ALTERNATIVES:
Denial of this Ordinance will result in cancellation of the Goodnight Barn Restoration Project.
RECOMMENDATIONS:
Approve the Ordinance.

FIRST AMENDMENT TO
AGREEMENT FOR PROFESSIONAL ARCHITECTURAL SERVICES
This First amendment to Agreement for Professional Architectural Services ("First
Amendment") is executed to be effective as of February 25, 2019 by and between the City of
Pueblo, Colorado, a Colorado municipal corporation ("Owner") and Hord Coplan Macht
Architects, Inc. a professional architectural firm ("Architect").
WHEREAS, Owner and Architect entered into that certain agreement for professional
architectural services dated November 27, 2017 (the "Agreement"); and,
WHEREAS, Owner and Architect desire to modify the Agreement pursuant to the
provisions set forth herein.
NOW, THEREFORE, in consideration of the foregoing premises, the mutual promises set
forth herein and other good and valuable consideration, the receipt and adequacy of which is
hereby acknowledged, Owner and Architect hereby agree to the following:
AGREEMENT
1. Scope of Services and Cost of Services. Architect shall render certain architectural,
engineering and related services for Owner in connection with the Goodnight Barn Rehabilitation
Project, in accordance with Amendment #1, dated February 25, 2019 including Appendices A, B,
C, D and E, attached hereto and incorporated herein by this reference.
2. Successors and Assigns. This First Amendment shall be binding upon and inure to
the benefit of the parties hereto and their respective successors and assigns.
3. Ratification. Except as expressly stated herein the Agreement shall remain in
full force and effect. If there is any conflict between the Agreement, or the First Amendment, the
terms of this First Amendment shall control.
4. Counterparts. This First Amendment may be executed in one or more
counterparts, each of which shall be deemed an original and all of which shall constitute one and
the same document with the same effect as if all parties had signed the same original. The parties
further agree that transmission of this First Amendment by telecopy or via email in a PDF format
shall be deemed transmission of the original First Amendment for all purposes.
IN WITNESS WHEREOF,the parties to this First Amendment have set forth their hand,to
be effective as of the effective date.

Appendix A
Scope of Services
Project Purpose:
The purpose of the project is to provide electrical engineering services to power and provide electrical
distribution and civil engineering services to provide drainage and site improvement plans along with
construction activities associated with the rehabilitation of the Goodnight Barn. Bidding and
construction activities will be based upon construction documents.
Scope of Services:
The scope of services includes electrical and civil design,construction documentation for inclusion in the
rehabilitation of the Goodnight Barn. These services shall include:
1. Electrical Consulting Services from HCM Architects, Inc. (enlighten Engineering, LLC) as outlined
in the attachment dated,January 29, 2019,Scope of Work
2. Civil Engineering Services from HCM Architects (JVA Engineering) as outlined in the attachment
dated,January 30,2019.
Special Provisions:
The project shall meet the Secretary of the Interior's Standards for the Treatment of Historic Properties.
