A RESOLUTION AUTHORIZING PUEBLO, A MUNICIPAL
CORPORATION TO ACCEPT THE GIFT OF THREE
PARCELS OF PROPERTY TOTALING APPROXIMATELY
0.39 ACRES WITHIN BLOCK 8 OF THE CAPITAL HILL
SUBDIVISION
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Quit-claim Deed relating to Lots Seventeen to Thirty-Two (17-32), Block Eight
(8) Capital Hill subdivision,dated January 16, 2019, a copy of which is attached hereto,
having been approved as to form by the City Attorney, is hereby approved and accepted.
The City hereby accepts the gift of the three parcels and expresses gratitude to Adrian
Acosta for his donation.
SECTION 2.
The Acting City Clerk is authorized and directed to record the attached Quit-claim
Deed in the office of the Pueblo County Clerk and Recorder.
SECTION 3.
The officers and staff of the City are authorized and directed to perform any and
all acts consistent with the intent of this Resolution to implement the policies and
procedures described herein.
SECTION 4.
This Resolution shall become effective immediately upon passage and approval.

PROPERTY TOTALING APPROXIMATELY 0.39 ACRES WITHIN BLOCK
8 OF THE CAPITAL HILL SUBDIVISION
SUMMARY:
This Resolution approves and accepts a donation by quit-claim deed of three parcels
totaling approximately 0.39 acres of property located within the 100-year flood plain east
of Fountain Creek between Bonnymede Road and Glenmore Road.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
In January 2019, the property owner of three parcels located along the east side of
Fountain Creek within the 100-year flood requested the City to consider accepting the
property as a donation since the property has very limited development potential due its
location within the floodplain. The City staff reviewed the property and has recommended
the City accept the donation of the property based on the property being surrounded by
City-owned property maintained as the Fountain Creek flood channel and adjacent trail
corridor (see attached map). This Resolution approves the City’s acceptance of the quit-
claim deed for the three parcels.
FINANCIAL IMPLICATIONS:
The City will be responsible for the ongoing maintenance of the three parcels that would
be added to the existing maintenance responsibilities along the Fountain Creek corridor.
BOARD/COMMISSION RECOMMENDATION:
Not applicable.
STAKEHOLDER PROCESS:
Not applicable.
ALTERNATIVES:
If the Resolution is not approved, the property will not be accepted by the City and the
property will continue to be a private in-holding within the Fountain Creek corridor.
RECOMMENDATION:
Approval of the Resolution.

QUITCLAIM DEED
THIS QUITCLAIM DEED, made this l uP day of January, 2019 between Adrian
Acosta whose address is 1115 '/2 Cedar Street, Pueblo, CO 81004 (hereinafter referred to as
"Grantor"), and the City of Pueblo, a Colorado municipal corporation, whose legal address is 1
City Hall Place, Pueblo, CO 81003 (hereinafter referred to as "Grantee"):
WITNESSESTH, that the Grantor, for and in consideration of the sum of TEN
DOLLARS ($10.00), and other good and valuable consideration, the receipt and sufficiency of
which is hereby acknowledged, has QUITCLAIMED, and by these presents does QUITCLAIM,
unto the Grantee, his heirs, successors and assigns, all right, title and interest that the Grantor has
in the real property,together with improvements,if any, situate, lying and being in Pueblo County,
State of Colorado, described as follows:
Lots Seventeen to Thirty-Two (17-32), Block Eight(8) Capital Hill
situated in the County of Pueblo, State of Colorado also known as Pueblo County Assessor Parcel
Numbers 419208002; 419208004 and 419208005.
IN WITNESS WHEREOF, this Quitclaim Deed is executed by Grantor to be effective
the day and year first above written.
