HomeMy WebLinkAbout09394 ORDINANCE NO. 9394 AN ORDINANCE AMENDING CHAPTER 4 OF TITLE XVII OF THE PUEBLO MUNICIPAL CODE RELATING TO ACCESSORY STRUCTURES BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (brackets indicate matter being deleted, underscoring indicates new matter being added) SECTION 1. Section 17-4-23(c)(4) and Section 17-4-23(c)(5) of Chapter 4, Title XVII of the Pueblo Municipal Code, as amended, is hereby modified to read as follows: Sec. 17-4-23. - Accessory buildings and structures. . . . (c) Unless otherwise specified, all detached accessory structures shall comply with the following: . . . Structures less than two hundred (200) square feet, and less than ten (10) (4.1) feet at the highest point shall be of similar color as the principal structure. The Administrative Official may waive or modify these requirements that do not specifically match the color of the primary structure but are determined to be complementary to the primary structure and do not detract from the aesthetic character of neighboring lands. (5) Detached accessory structures two hundred (200) square feet or more shall be approved by the Planning and Community Development Department prior to installation, and shall comply with the following requirements: a. Reserved; \[(8)\] b. Structures larger than two hundred (200)square feet, or higher than eight ten (10)shall be architecturally compatible with the feet at the highest point principal structure ; SECTION 2. The officers and staff of the City are authorized and directed to perform any and all acts consistent with this Ordinance which are necessary to implement the policies and procedures described herein. SECTION 3. This Ordinance shall become effective thirty (30) days following final passage and approval. Nicoll and Members of City Council CC: Sam Azad, City Manager VIA: Brenda Armijo, Acting City Clerk FROM: Steven Meier, Director of Planning and Community Development SUBJECT: AN ORDINANCE AMENDING CHAPTER 4 OF TITLE XVII OF THE PUEBLO MUNICIPAL CODE RELATING TO ACCESSORY STRUCTURES SUMMARY: Attached for consideration is a text amendment that clarifies the text amendment approved at the November 26, 2018 City Council meeting pertaining to Chapter 4 of Title XVII of the Pueblo Municipal Code relating to accessory structures. PREVIOUS COUNCIL ACTION: City Council approved Ordinance No. 9380 at the November 26, 2018 City Council meeting addressing text amendments to Chapter 2 and Chapter 4 of Title XVII of the Pueblo Municipal Code related to shipping containers and accessory structures. BACKGROUND: This Ordinance clarifies amendments that were adopted by City Council on November 26, 2018 pertaining to Section 17-4-23(c)(4) and Section 17-4-23(c)(5) of Chapter 4, Title XVII of the Pueblo Municipal Code (“PMC”) addressing the size, color, and architectural compatibility of accessory structures. This Ordinance would add an additional paragraph, Sec. 17-4-23( c) 4.1 allowing for structures that are less than two hundred (200) square feet, and less than ten (10) feet at the highest point to be of similar color as the principal structure. Additionally, the Administrative Official would have the authority to waive or modify the requirement for matching the color of the primary structure, if it is determined that the color of the accessory structure less than two hundred (200) square feet or less than ten (10) feet at the highest point is complementary to the primary structure and does not detract from the aesthetic character of neighboring lands. Section 17-4-23(c)(5) b. would require structures larger than two hundred (200) square feet, or higher than ten (10) feet at the highest point to be architecturally compatible with a principal structure. This would provide consistency in the PMC for architectural compatibility of detached garages, workshops and other structures with principal structures such as residential houses and commercial buildings. FINANCIAL IMPLICATIONS: There are no financial implications for the City. BOARD/COMMISSION RECOMMENDATION: This Ordinance clarifies Section 17-4-23(c)(4) and Section 17-4-23(c)(5) of Chapter 4, Title XVII of the Pueblo Municipal Code that was previously acted upon by the Planning and Zoning Commission, at their October 10, 2018 Regular Meeting. STAKEHOLDER PROCESS: This Ordinance clarifies Section 17-4-23(c)(4) and Section 17-4-23(c)(5) of Chapter 4, Title XVII of the Pueblo Municipal Code that was previously adopted through a public hearing held by City Council on November 26, 2018. ALTERNATIVES: If City Council does not approve this Ordinance, Title XVII of the Pueblo Municipal Code will not be amended to reflect the proposed changes. RECOMMENDATION: Approval of the Ordinance.
