HomeMy WebLinkAbout09386ORDINANCE NO. 9386 AN ORDINANCE AMENDING SECTION 7-3-17 OF TITLE Vll OF THE PUEBLO MUNICIPAL CODE RELATING TO COMMUNITY SOLID WASTE CLEAN-UP PROGRAM AND AUTHORIZING LIMITS AND FEES WITH RESPECT TO SUCH PROGRAM BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (brackets indicate matter being deleted, underscoring indicates new matter being added) SECTION 1. Section 17 of Chapter 3 of Title VII of the Pueblo Municipal Code is hereby amended as follows: Sec. 7-3-17. - Community solid waste clean-up program. Mayor The \[City Manager\] shall annually recommend to the City Council, as part of the City budget process, any fees that may be assessed under Paragraph 7-3-16(3), and the appropriation of such fees to fund any community clean-up program for The Mayor is reduction or disposal of solid waste from areas located within the City. further authorized to adopt a program wherein items typically found to be illegally disposed of within the City, excluding hazardous waste or electronic equipment, are received and disposed of by the City. The program shall exist solely for the purpose of reducing illegal disposal of solid waste within the City. The Mayor is authorized to collect a fee in the amount of ten dollars ($10.00) for each item other than tires and items deemed qualifying recyclables and one dollar ($1.00) for each passenger-sized tire, or such other amount as may be established by resolution of the City Council, for receipt and disposal of any one item and to limit the availability of the program to a set number of items per resident or residential address within the City. SECTION 2. The program authorized by this Ordinance was initiated in February of 2018. Fees charged under the program have been ten dollars ($10.00) for each item other than tires and items deemed qualifying recyclables and one dollar ($1.00) for each passenger-sized tire. Said program originally allowed for two items per residential address within the City. After October 15, 2018 and currently, the program allows for four items per residential address within the City. Said program as initiated and all fees collected thereunder are hereby confirmed and ratified. SECTION 3. Pursuant to Ordinance No. 9265 and until such time as the first Mayor takes office, the City Manager shall exercise all duties and powers of the Mayor under Section 7-3-17, as amended. SECTION 4. The officers of the City are directed and authorized to perform any and all acts consistent with the intent of this Ordinance to effectuate the policies and procedures described herein. SECTION 5. This Ordinance shall become effective thirty days after final passage. Nicoll, and Members of City Council CC: Sam Azad, City Manager VIA: Brenda Armijo, Acting City Clerk FROM: Jeff Bailey, Acting Public Works Director SUBJECT: AN ORDINANCE AMENDING SECTION 7-3-17 OF TITLE Vll OF THE PUEBLO MUNICIPAL CODE RELATING TO COMMUNITY SOLID WASTE CLEAN-UP PROGRAM AND AUTHORIZING LIMITS AND FEES WITH RESPECT TO SUCH PROGRAM SUMMARY: Attached for consideration is a text addition to Title Vll of the Pueblo Municipal Code relating to community solid waste clean-up program and authorizing limits and fees with respect to such program. PREVIOUS COUNCIL ACTION: City Council has discussed the issue of illegal dumping for many years. At the end of 2017, City Council directed the Public Works Department to develop a program that makes it more affordable for City residents to dispose of household furniture items, such as sofas, recliners, and mattresses. BACKGROUND: Pueblo City Council has been searching for solutions to an ever-increasing problem regarding the problem of illegal dumping of large items (sofas, mattresses, tires) within the City limits. Currently, City Council is seeking a sustainable solution to reduce the problem of illegal dumping by selling low-cost vouchers to City residents to help off-set program costs. In February 2018, a site was opened at 1595 Stockyard Rd. to City residents for disposal of large items such as sofas, tables, recliners, and mattresses; but excluding items that may contain hazardous waste such as refrigerators, and electronic items (computers, televisions). Currently, the program is run by the Public Works Department. In 2019, the program will employ one full-time Utility Worker lll to oversee the daily activities of the program, two part-time utility workers, and one full time employee to manage the program, at approximately 15 hours per week. FINANCIAL IMPLICATIONS: Vouchers will be sold to help off-set a portion of the program cost. BOARD/COMMISSION RECOMMENDATION: Not applicable. STAKEHOLDER PROCESS: Not applicable.
