AN ORDINANCE CHANGING ZONING RESTRICTIONS
FOR PARCELS OF LAND LOCATED BETWEEN ST.
CLAIR AVENUE AND ASPENCREST DRIVE FROM A-1,
AGRICULTURAL DISTRICT TO R-2U, SINGLE FAMILY
RESIDENTIAL DISTRICT
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The zoning restrictions covering the following described properties, and in addition
half of all adjacent public roadway and alley rights-of-way, inclusively identified in the
attached Rezone Exhibit is hereby changed from A-1, Agricultural District, to R-2U,
Residential District:
A PORTION OF THE WEST HALF OF SECTION 4, TOWNSHIP 21
SOUTH, RANGE 65 WEST OF THE SIXTH PRINCIPAL MERIDIAN,
COUNTY OF PUEBLO, STATE OF COLORADO, BEING DESCRIBED AS
FOLLOWS:
BASIS OF BEARINGS: THE WEST LINE OF THE NORTHWEST

SECTION 2.
The officers and staff of the City are authorized and directed to perform any and
all acts consistent with the intent of the Ordinance to implement the policies and
procedures described herein.
SECTION 3.
This Ordinance shall become effective immediately upon final passage and
approval.

SUBJECT: AN ORDINANCE CHANGING ZONING RESTRICTIONS FOR PARCELS
OF LAND LOCATED BETWEEN ST. CLAIR AVENUE AND ASPENCREST
DRIVE FROM A-1, AGRICULTURAL DISTRICT TO R-2U, SINGLE
FAMILY RESIDENTIAL DISTRICT
SUMMARY:
The applicant requests rezoning the subject properties from Agricultural (A-1 zone) district
to Residential (R-2U zone) district.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
The subject property is located immediately west of the partially-developed subdivision
known as Regency Crest Filing 10. The applicant is requesting to rezone the property
from A-1 to R-2U to bring the property into a zoning district that will accommodate single-
family residential development. The rezoning is in compliance with the Regency Crest
West Development Plan approved by the Planning and Zoning Commission and also
complies with the amended Regency Crest West Annexation Agreement. The associated
subdivision request will result in the creation of thirty-three lots to implement the
residential development.
FINANCIAL IMPLICATIONS:
There are no financial implications for the City.
BOARD/COMMISSION RECOMMENDATION:
The Planning and Zoning Commission, at their August 8, 2018 Regular Meeting, voted 7-
0 to recommend approval.
STAKEHOLDER PROCESS:
The Planning Department sent out Notice of the Planning and Zoning Commission Public
Hearing to all property owners located within 300 feet of the subject property.
A Public Notice poster was placed on the subject property 15 days prior to the Public
Hearing.
ALTERNATIVES:
If City Council does not approve this Ordinance, the current zoning would remain.
Upon request of City Council, the Ordinance could be returned to the Planning and Zoning
Commission for consideration of proposed modifications.
RECOMMENDATION:
Approval of the Ordinance.
