Davenport – Police Department Chief Shawn Shelton – Fire Department Dispatch Manager Laura Wittrup – Police Department SUBJECT: A RESOLUTION AUTHORIZING THE FILING OF AN APPLICATION FOR AN INCREASE TO THE CITY OF PUEBLO’S 911 SURCHARGE WITH THE COLORADO PUBLIC UTILITIES COMMISSION SUMMARY: Any governing body requesting approval pursuant to §29-11-102(2)(b), C.R.S., for an emergency telephone charge in excess of the limit established by §29-11-102(2), C.R.S., must file an application with the Colorado Public Utilities Commission (PUC) pursuant to 4 Code of Colorado Regulations (CCR) 723-2-2002 and 723-2-2147. PREVIOUS COUNCIL ACTION: The initial emergency telephone charge of forty cents ($0.40) was created by Council during the late 1980’s with passage of Ordinance 6644. In 2009, Council approved Ordinance 7471 increasing the surcharge to seventy cents ($0.70) to match the statutory limit established by the PUC. The surcharge has not changed since. BACKGROUND: The City of Pueblo’s 911 Communications Center is requesting authorization to apply to the PUC for an increase to the City’s emergency telephone surcharge. The Communications Center has used the E911 Emergency Telephone Charge Fund Reserves to fund emergency communications projects not covered through other funding sources within the City. Emergency communications equipment purchases have decreased the current funds, and an increase in line with comparable jurisdictions is warranted to provide for future purchase of necessary 911 emergency services equipment. The City’s current seventy cent ($0.70) surcharge has not kept up with inflation and falls short of what many other agencies within the State of Colorado have established for their emergency telephone charge. Current 911 surcharges in Colorado average $1.05, with a high of $1.75. If this request is approved, an application will be completed and submitted to the PUC. The agency will review all documents and provide a recommendation related to any proposed increase to the City of Pueblo’s 911 surcharge. FINANCIAL IMPLICATIONS: The current seventy cent ($0.70) emergency telephone charge is expected to generate approximately $825,000 in revenue per year. An eighty cent ($0.80) increase in the City’s 911 surcharge would likely generate an additional $902,000 per year, for a total projected revenue of $1.7 million. BOARD/COMMISSION RECOMMENDATION: None. STAKEHOLDER PROCESS: There is no stakeholder process required for this application process. ALTERNATIVES: Decline approval to proceed with the application process and have the emergency telephone charge remain at its current rate of seventy cents ($0.70). This would dramatically decrease or eliminate funding potential and future projects directly related to the provision of 911 services for the City of Pueblo. RECOMMENDATION: Approval of the Resolution. ATTACHMENTS: RESOLUTION NO: 14088 A RESOLUTION AUTHORIZING THE FILING OF AN APPLICATION FOR AN INCREASE TO THE CITY OF PUEBLO’S 911 SURCHARGE WITH THE COLORADO PUBLIC UTILITIES COMMISSION WHEREAS, the City of Pueblo’s 9-1-1 Communications Center is the sole Public Safety Answering Point (PSAP) for all 9-1-1 calls placed within the City of Pueblo; and WHEREAS, any governing body requesting approval pursuant to §29-11-102(2)(b), C.R.S., for an emergency telephone charge in excess of the limit established by §29-11-102(2), C.R.S., must file an application with the Colorado Public Utilities Commission pursuant to 4 Code of Colorado Regulations (CCR) 723-2-2002 and 723-2-2147; and WHEREAS, the City of Pueblo’s seventy cent ($0.70) surcharge has not kept up with inflation and falls short of what many other agencies within the State of Colorado have established as their surcharges; and WHEREAS, the current 911 surcharge for Pueblo County is $1.50; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The application for an increase to the City of Pueblo’s 911 surcharge, including all understandings and assurances contained therein, to aid in the provision of 911 services to the City of Pueblo, is hereby approved and authorized to be filed with the Colorado Public Utilities Commission. SECTION 2. The City Manager is hereby authorized to submit the application and any other documentation required by the Colorado Public Utilities Commission on behalf of the City of Pueblo. SECTION 3. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Resolution and the attached instruments to effectuate the transactions described therein. SECTION 4. This Resolution shall become effective immediately upon passage and approval.
