SUBJECT:A RESOLUTION APPROVING AN AGREEMENT IN AN AMOUNT NOT
TO EXCEED $50,000 BETWEEN THE CITY OF PUEBLO AND
FELSBURG, HOLT & ULLEVIG, PROJECT NO. 18-095 PROFESSIONAL
CONSULTANT SERVICES FOR STORMWATER COMPLIANCE
SUMMARY:
This Resolution accepts an agreement between the City and Felsburg, Holt & Ullevig to
provide professional services for Stormwater MS4 Permit Compliance consultant.
PREVIOUS COUNCIL ACTION
:
Ordinance 9354, passed on October 22, 2018, established Project SW1805 and
transferred, budgeted, and appropriated funds for Stormwater Compliance Consultation
Services.
BACKGROUND
:
City of Pueblo has had a Municipal Separate Storm Sewer Systems (MS4) Permit with
the Colorado Department of Public Health & Environment since 2003. This permit
regulates stormwater runoff within the city limits of Pueblo and authorizes the discharge
into the Arkansas River.
In April 2016, a new MS4 permit was issued to the City that contains numerous
revisions from the previous permit. Some of the revisions has required the Stormwater
Enterprise to seek the assistance of a consulting service to assure the permit
requirements are being met. The consultant will assist with implementing improvements
and updates to the Stormwater Enterprise current program for maintaining compliance
with the new MS4 Permit and its new requirements.
FINANCIAL IMPLICATIONS
:
The cost of the agreement is not to exceed a price of $50,000. Funds are available as
transferred, budgeted and appropriated in Ordinance 9354, passed on October 22,
2018.

Alternative No. 1 – No Action
The event of no action being taken, could result in the failure of the Stormwater
Department to meet MS4 regulations leading to possible fines.

A RESOLUTION APPROVING AN AGREEMENT IN AN
AMOUNT NOT TO EXCEED $50,000 BETWEEN THE CITY OF
PUEBLO AND FELSBURG, HOLT & ULLEVIG, PROJECT NO.
18-095 PROFESSIONAL CONSULTANT SERVICES FOR
STORMWATER COMPLIANCE
WHEREAS, proposals for the Project No. 18-095 Stormwater Compliance Consultant
Services (“RFP”) have been received and examined; and
WHEREAS, the proposal of, Felsburg, Holt & Ullevig, 6300 South Syracuse Way, Suite
600, Centennial, CO, was determined to be the most advantageous in terms of criteria as
designated in the RFP and has been determined by the Purchasing Agent and Evaluation
Committee to be in the best interest of the City; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
This contract is for Stormwater Compliance Consultant Services in the City of Pueblo.
Contract Agreement for Stormwater Compliance Consultant Services is hereby awarded to said
bidder in the amount of $50,000.
SECTION 2.
Funds for Project 18-095 shall be from the Stormwater Project SW1805.
SECTION 3.
The President of City Councilis hereby authorized to execute said contract on behalf of
Pueblo, a Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and
attest the same.
SECTION 4.
The officers and staff of the City are directed and authorized to perform any and all acts
consistent with the intent of this Resolution and the contract to effectuate the transactions
described therein.
SECTION 5.
This Resolution shall become effective immediately upon passage and approval.
