HomeMy WebLinkAbout09345Reception 2121054 10/25/2018 03:41 :17 PM ORDINANCE NO. 9345 AN ORDINANCE VACATING 11TH AND 12TH STREETS, BETWEEN SANTA FE AVENUE AND ALBANY AVENUE BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The following streets: All of 11th Street located east of the easterly Right-of-Way line of Santa Fe Avenue and west of the westerly Right-of-Way line of Albany Avenue as presently located in the City of Pueblo, County of Pueblo, State of Colorado. AND All of 12th Street located east of the easterly Right-of-Way line of Santa Fe Avenue and west of the westerly Right-of-Way line of Albany Avenue as presently located in the City of Pueblo, County of Pueblo, State of Colorado. attached hereto, is hereby vacated. SECTION 2. The officers and staff of the City are authorized and directed to perform any and all acts consistent with the intent of this Ordinance to implement the policies and procedures described herein. SECTION 3. The vacation is approved with the following condition: 2. Upon future development or subdivision, rezone the 12th Street right-of-way to B-4, Central Business District. SECTION 4. This Ordinance shall be approved but shall not become effective until (a) the specific conditions set forth in the above section 3 have been satisfied; and (b) the final vacation plat is recorded in the office of the Pueblo County Clerk and Recorder. If the vacation plat is not recorded within one (1) year after of this Ordinance, or within any extended period granted by Ordinance of the City Council,this Ordinance shall automatically be rescinded and repealed thirty(30)days after written notice of such rescission and repeal is given to the applicant. Nicoll and Members of City Council CC: Sam Azad, City Manager VIA: Brenda Armijo, Acting City Clerk FROM: Steven Meier, Director of Planning and Community Development THTH SUBJECT: AN ORDINANCE VACATING 11 AND 12 STREETS, BETWEEN SANTA FE AVENUE AND ALBANY AVENUE SUMMARY: THth The applicant is requesting to vacate the portion of 11 and 12 Streets that are located between Santa Fe Avenue and Albany Avenue. PREVIOUS COUNCIL ACTION: None. BACKGROUND: thth The applicant is requesting to vacate the portion of 11 and 12 Streets between Santa Fe thth Avenue and Albany Avenue. With this vacation, the 11 and 12 Street rights-of-way will become part of the property owned by Parkview Medical Center. The purpose of the vacation is for future th use and subdivision. The 12 Street right-of-way is currently zoned S-1, Governmental Use District; upon future development, the applicant will be required to rezone that portion of the property to B-4, Central Business District. FINANCIAL IMPLICATIONS: This vacation will result in the City no longer being required to maintain these sections of roadways. BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission, at their October 11, 2017 Regular Meeting, voted 5-0-2 to recommend approval with the following conditions of approval: 1. Revise the vacation plat to include the reservation language provided by the Public Works Department th 2. Upon future development or subdivision, rezone the 12 Street right-of-way to B-4, Central Business District. Condition No. 1 has been complied with by the applicant and is incorporated into the final plans. Condition No. 2 shall remain a condition of approval. STAKEHOLDER PROCESS: The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing to all property owners located within 300 feet of the subject property. A Public Notice poster was placed on the subject property 15 days prior to the Public Hearing. ALTERNATIVES: If City Council does not approve this Ordinance, the portions of the rights-of-way would remain dedicated, limiting the applicant’s ability to develop the property. Upon request of City Council, the Ordinance could be returned to the Planning and Zoning Commission for consideration of proposed modifications. RECOMMENDATION: Approval of the Ordinance.
