HomeMy WebLinkAbout09334 ORDINANCE NO. 9334 AN ORDINANCE CHANGING ZONING RESTRICTIONS FOR PORTIONS OF PARCELS OF LAND LOCATED AT 1314 HALLECK AVENUE AND 1629 WEST 13TH STREET FROM R-2, SINGLE FAMILY RESIDENTIAL DISTRICT, TO I-2, INDUSTRIAL DISTRICT BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering the following described properties, and in addition half of all adjacent public roadway and alley rights-of-way, inclusively identified in the attached Rezone Exhibit is hereby changed from R-2, Single Family Residential District, to I-2, Industrial District: LOTS 21, 22, 23, 25, 26, 27, AND 28, BLOCK 7, ADEE, CHAMBERLIN & WILEY’S SUBDIVISION SECTION 2. The officers and staff of the City are authorized and directed to perform any and all acts consistent with the intent of the Ordinance to implement the policies and procedures described herein. SECTION 3. This Ordinance shall become effective immediately upon final passage and approval. Nicoll and Members of City Council CC: Sam Azad, City Manager VIA: Brenda Armijo, Acting City Clerk FROM: Steven Meier, Director of Planning and Community Development SUBJECT: AN ORDINANCE CHANGING ZONING RESTRICTIONS FOR A PORTION OF PARCELS OF LAND LOCATED AT 1314 HALLECK AVENUE AND TH 1629 WEST 13 STREET FROMR-2, SINGLE FAMILY RESIDENTIAL DISTRICT, TO I-2, INDUSTRIAL DISTRICT SUMMARY: The applicant requests rezoning the portions of the subject properties from Single-Family Residential (R-2 zone) district to Industrial (I-2 zone) district. PREVIOUS COUNCIL ACTION: None. BACKGROUND: The subject properties are generally located on the northeast corner of Halleck Avenue and West 13th Street. Lots 24, 29 and 30 and adjacent rights of way are currently I-2, Industrial. The applicant is requesting to rezone lots 21, 22, 23, 25, 26, 27, and 28 and adjacent rights of way from R-2, Single Family Residential, to I-2, Industrial, to use the property for storage and to park commercial vehicles. The intended uses are not permitted in the existing R-2 zone district. Rezone to I-2 will enable as a use by right as a contractor’s yard and/or an outdoor storage facility. All outdoor storage areas shall be suitably fenced. Future development will require site plan review. FINANCIAL IMPLICATIONS: There are no financial implications for the City. BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission, at their July 11, 2018 Regular Meeting, voted 6-0 to recommend approval (Commissioner Avalos absent). STAKEHOLDER PROCESS: The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing to all property owners located within 300 feet of the subject property. A Public Notice poster was placed on the subject property 15 days prior to the Public Hearing. ALTERNATIVES: If City Council does not approve this Ordinance, the current zoning would remain. Upon request of City Council, the Ordinance could be returned to the Planning and Zoning Commission for consideration of proposed modifications. RECOMMENDATION: Approval of the Ordinance.
