HomeMy WebLinkAbout14012 RESOLUTION NO. 14012 A RESOLUTION AUTHORIZING THE CITY OF PUEBLO TO REFUND SANITARY SEWER FEES TO CONTINENTAL MOBILE HOME PARK WHEREAS, the City’s Wastewater Department has been notified that Continental Mobile Home Park paid an overage of wastewater fees due to a high consumption during the monitoring period; and WHEREAS, pursuant to Section 16-6-6 of the Pueblo Municipal Code, the Director of Wastewater has determined that grounds exist for a refund pursuant to Section 16-6-5 of the Code; and WHEREAS, a refund for the paid amount can only be authorized by Pueblo City Council; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The City shall refund Continental Mobile Home Park the sum of $803.52 for the overage of wastewater fees paid for Continental Mobile Home Park during the periods of April 2016 through March 2018. SECTION 2. Such refund shall be paid through the Claim Settlement Fund, Account Number 5254110055007 in the amount of $803.52. SECTION 3. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Resolution and the contract to effectuate the transactions described therein. SECTION 4. This Resolution shall become effective immediately upon passage and approval. Nicoll and Members of City Council CC: Sam Azad, City Manager VIA: Brenda Armijo, Acting City Clerk FROM: Nancy Keller, Wastewater Director SUBJECT: A RESOLUTION AUTHORIZING THE CITY OF PUEBLO TO REFUND SANITARY SEWER FEES TO CONTINENTAL MOBILE HOME PARK SUMMARY: This Resolution authorizes the City of Pueblo to refund overpaid sanitary sewer fees to Continental Mobile Home Park. PREVIOUS COUNCIL ACTION : None BACKGROUND : The Wastewater Department received a written request from Sam Serracino, who is a representative for the Continental Mobile Home Park. Mr. Serracino is seeking a refund on the thth sewer fees for the two accounts located at 2327 East 4 Street and 2044 East 4 Street. It has been determined that the mobile home park uses more water during the sewer monitoring months of January and February to prevent the freezing of pipes than the rest of the year. Per records from the Pueblo Board of Water Works, it has been proven that the mobile home has the highest water consumption during the months of January and February. The City has deemed it unfair to base the sewer fees upon the January and February consumption rates for this user. The City has moved the mobile home park accounts to bill actual sewer every month instead of basing the monthly sewer fees off the January and February period. Pursuant to City Ordinance 16-6-7, refunds based upon sewer user charges appearing on billings issued more than ninety (90) days prior to receipt of a written request can only be authorized by City Council and are limited to a maximum period of two years. On behalf of the Continental Mobile Home Park, Mr. Serracino is requesting the refund of wastewater fees in the amount of $803.52 for the excess fees charged to the mobile home park during the last two years. FINANCIAL IMPLICATIONS : The refund of $803.52 will be paid from Claim Settlement Fund, Account Number 5254110055007. Funds are available and have been appropriated. BOARD/COMMISSION RECOMMENDATION : Not applicable STAKEHOLDER PROCESS : None ALTERNATIVES : Alternative No. 1 – No Action The Continental Mobile home park will not receive compensation for sanitary sewer fees. RECOMMENDATION : Approval of the Resolution.
