Kogovsek, City Attorney SUBJECT: AN ORDINANCE AMENDING SECTION 6 OF CHAPTER 4 OF TITLE I OF THE PUEBLO MUNICIPAL CODE AUTHORIZING THE CITY COUNCIL TO HIRE THE PERSONNEL NECESSARY TO ENABLE THE CITY COUNCIL TO ADEQUATELY PERFORM ITS DUTIES SUMMARY: Attached is a proposed Ordinance which authorizes the City Council to hire the personnel necessary to enable the Council to perform its duties. PREVIOUS COUNCIL ACTION: There has been no previous council action regarding changes made necessary by the change in the form of government. BACKGROUND: This Ordinance is made necessary by the adoption of Ballot Issue 2A by the voters of the City of Pueblo on November 7, 2017. Ballot Question 2A changed the form of government of the City from a Council-City Manager format to a Mayor-Council format. Amended Charter Section 3-5(h) specifically authorizes the City Council to hire the personnel necessary to enable the Council to adequately perform its duties. FINANCIAL IMPLICATIONS: The financial implications associated with the change in the form of government are unknown at this time. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: Not applicable to this Ordinance. ALTERNATIVES: If City Council does not approve this Ordinance, there will be ambiguity as to the personnel status of persons hired by City Council. RECOMMENDATION: Approve the Ordinance. Attachments: Proposed Ordinance ORDINANCE NO. 9299 AN ORDINANCE AMENDING SECTION 6 OF CHAPTER 4 OF TITLE I OF THE PUEBLO MUNICIPAL CODE AUTHORIZING THE CITY COUNCIL TO HIRE THE PERSONNEL NECESSARY TO ENABLE THE CITY COUNCIL TO ADEQUATELY PERFORM ITS DUTIES BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (brackets indicate matter being deleted, underscoring indicates new matter being added) SECTION 1. Chapter 4 of Title I of the Pueblo Municipal Code is hereby amended to read as follows: Sec. 1-4-6. – Annual audit; employing accountants; report; hiring of personnel (a) Annually the City Council shall provide for a special audit of the general accounts of the City, and for that purpose the City Council shall secure the professional services of certified public accountants familiar with municipal accounting. The report of such audit shall be made available to the public as a public record. (b) The City Council shall hire the personnel necessary to enable the Council to adequately perform its duties. All persons hired shall be selected on the basis of their training, experience, qualifications and fitness for the particular job to be performed. All such personnel employed by City Council shall be members of the Unclassified Service. City Council may also retain independent contractors to perform such services as City Council deems necessary. Such independent contractors shall not be employees of the City and shall not be entitled to any employment benefits which the City provides to City employees. SECTION 2. The officers and staff of the City are authorized and directed to perform any and all acts consistent with this Ordinance to implement the policies and procedures described herein. SECTION 3. This Ordinance shall become effective on the date in which the Mayor takes office.
