AN ORDINANCE AMENDING SECTION 1 OF CHAPTER 4 OF
TITLE I OF THE PUEBLO MUNICIPAL CODE TO CONFIRM THE
AUTHORITY OF THE CITY COUNCIL TO APPROVE BY
RESOLUTION APPLICATIONS OF THE CITY OF PUEBLO, A
MUNICIPAL CORPORATION, FOR FEDERAL, STATE AND
LOCAL GRANTS
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (brackets indicate matter
being deleted, underscoring indicates new matter being added)
SECTION 1.
Chapter 4 of Title I of the Pueblo Municipal Code is hereby amended to read as follows:
and authority to approve grant
Sec. 1-4-1. – Council procedures and rules
applications by resolution.
(a)
The City Council by resolution shall adopt suitable rules to govern its
procedures.
(b) The City Council shall have the authority to approve, by resolution,
applications for grant funds from the federal, state or local governments.
SECTION 2.
The officers and staff of the City are authorized and directed to perform any and all acts
consistent with this Ordinance to implement the policies and procedures described herein.
SECTION 3.
This Ordinance shall become effective on the date in which the Mayor takes office.

PUEBLO, A MUNICIPAL CORPORATION, FOR FEDERAL, STATE AND LOCAL
GRANTS
SUMMARY:
Attached for consideration is a proposed Ordinance which confirms the authority of City Council
to approve, by Resolution, applications made by the City for federal, state and local grants.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
The Pueblo City Council has historically approved grant applications by Resolution. In 2017, City
Council approved, by Resolution, fourteen (14) grant applications and one (1) grant application
amendment. Resolutions can be posted and approved in as little as five (5) days. Under the
Charter Amendment, Ordinances will take approximately four to six weeks to approve. Because
grant applications sometimes have short timelines, staff recommends that the City Council adopt
an Ordinance which confirms City Council’s authority to approve grant applications by Resolution.
Ballot Question 2A, approved by the voters of the City of Pueblo on November 7, 2017, does not
specifically address whether grant applications must be approved by Resolution or by Ordinance.
It is the legal opinion of the City Attorney that City Council has the power to confirm its authority
to approve grant applications by Resolution. The grants themselves must be approved by
Ordinance in order to comply with the Charter Amendment.
FINANCIAL IMPLICATIONS:
This will permit City staff to submit federal, state and local grant applications in a timely manner.
Consequently, this Ordinance will work toward the financial benefit of the City.

Not applicable to this Ordinance.
STAKEHOLDER PROCESS:
Not applicable to this Ordinance.
ALTERNATIVES:
If City Council does not approve this Ordinance, there will be ambiguity as to whether Council
must approve grant applications by Resolution or by Ordinance.
RECOMMENDATION:
Approve the Ordinance.
