SUBJECT: AN ORDINANCE AMENDING ZONING RESTRICTIONS FOR
PROPERTIES LOCATED AT 2808 THATCHER AVENUE AND 2816
THATCHER AVENUE
SUMMARY:
The applicant is requesting to rezone the subject properties from R-2 to B-2, Subregional
Business District and B-1 to B-2, Subregional Business District
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
The applicant is requesting to rezone two of the parcels of the Sunset Inn property located
at 2808 Thatcher Avenue and 2816 Thatcher Avenue to have all of the commercial
property associated with the restaurant operation in the same zone district. The applicant
is requesting to rezone the property addressed at 2808 Thatcher Avenue from B-1 to B-
2, Subregional Business District and the property addressed at 2816 Thatcher Avenue
from R-2 to B-2, Subregional Business District to accommodate the construction of
additional parking that will add approximately 7,800 square feet of parking for the
restaurant. The proposed parking lot is not permitted in the existing R-2 Zone District;
however, it is allowed with a Special Use Permit in the B-2 Zone District as a Parking Lot.
The parking lot use is not considered an accessory use to the Sunset Inn because it is
located on separate lots and across the alley from the main business.The properties
border Thatcher Avenue and Henry Avenue west of Prairie Avenue.
FINANCIAL IMPLICATIONS:
There are no financial implications for the City.
BOARD/COMMISSION RECOMMENDATION:
The Planning and Zoning Commission, at their May 9, 2018 Regular Meeting, voted 5-0
to (Eslinger and Lucas absent) recommend approval with the following conditions:
1. Provide a landscape plan that is approved by staff prior to being scheduled for City
Council and the approved landscape improvements shall be completed within one
(1) year from the date of approval of the rezoning at City Council.
2. Detention and Water Quality will be required at the time of development.
The recommended conditions of approval from Planning and Zoning Commission have
been revised in the Ordinance to reflect the removal of the requirement to provide plans
prior to being scheduled for City Council.
STAKEHOLDER PROCESS:
The Planning Department sent out Notice of the Planning and Zoning Commission Public
Hearing to all property owners located within 300 feet of the subject property.
A Public Notice poster was placed on the subject property 15 days prior to the Public
Hearing.
ALTERNATIVES:
If City Council does not approve this Ordinance, the current zoning would remain.
Upon request of City Council, the Ordinance could be returned to the Planning and Zoning
Commission for consideration of proposed modifications.
RECOMMENDATION:
Approval of the Ordinance.

ORDINANCE NO. 9292
AN ORDINANCE AMENDING ZONING RESTRICTIONS FOR
PROPERTIES LOCATED AT 2808 THATCHER AVENUE AND
2816 THATCHER AVENUE
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The zoning restrictions covering the following described properties and generally identified in the
attached Rezone Exhibit are hereby changed from R-2 to B-2, Subregional Business District and
B-1 to B-2, Subregional Business District:
All of Lots 1 through 5, and All of Lots 45 through 50, both inclusive in Block 1;
along with the adjacent east one-half of Henry Avenue adjacent to Lots 1 through
5, along with the adjacent south one-half of Thatcher Avenue adjacent to Lots 1
and 50, along with the adjacent west one-half of S. Prairie Avenue adjacent to Lots
45 through 50 and all of the alley lying between Lots 1 through 5, and Lots 46
through 50 both inclusive along with the east one-half of the alley adjacent to Lot
45 all in WEST POINT according to the recorded plat as filed for record in the
records of the Pueblo County Clerk, City of Pueblo, County of Pueblo.
SECTION 2.
The officers and staff of the City are directed and authorized to perform any and all acts
consistent with the intent of the Ordinance to effectuate the policies and procedures described
herein.
SECTION 3.
This Ordinance shall become effective immediately upon final passage and approval.
