SUBJECT: AN ORDINANCE CHANGING ZONING RESTRICTIONS FOR A PARCEL
OF LAND LOCATED AT 1635 SOUTH PUEBLO BOULEVARD FROM R-
5, MULTIPLE RESIDENTIAL AND OFFICE DISTRICT TO B-3, HIGHWAY
AND ARTERIAL BUSINESS DISTRICT
SUMMARY:
The applicant is requesting to rezone the subject property from R-5 to B-3, Highway and
Arterial Business District.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
The owner of the property located at 1635 South Pueblo Boulevard is requesting to
rezone the property from R-5 to B-3 to allow for an Electronic Variable Message (EVM)
sign to the installed on the property. The proposed EVM sign is not permitted in the
existing R-5 Zone District; however, it is allowed as a permitted use in the B-3 Zone
District. The installation of an EVM sign will require the issuance of a building permit. The
applicant will need to comply with the requirements of the Pueblo Municipal Code as
conditions of the issuance of a building permit for the installation of an EVM sign. These
conditions of the building permit will be required to ensure the property will not have a
negative impact on the surrounding properties. The rezoning of the property to B-3 would
be considered appropriate given the location on Pueblo Boulevard.
FINANCIAL IMPLICATIONS:
There are no financial implications for the City.
BOARD/COMMISSION RECOMMENDATION:
The Planning and Zoning Commission, at their August 9, 2017 Regular Meeting, voted 5-
0 to recommend approval with the following conditions:
1. Provide a landscape plan, prepared and stamped by a Licensed Landscape
Architect for Staff review and approval.
2. Install landscaping and site improvements (as per approved site plan) within one
(1) year from the date of approval of the rezoning at City Council.
The recommended conditions of approval from Planning and Zoning Commission have
been revised in the Ordinance to reflect the removal of the requirement to provide plans
prior to being scheduled for City Council, and compliance with landscape requirements
be a condition prior to the installation of the EVM sign.
STAKEHOLDER PROCESS:
The Planning Department sent out Notice of the Planning and Zoning Commission Public
Hearing to all property owners located within 300 feet of the subject property.
A Public Notice poster was placed on the subject property 15 days prior to the Public
Hearing.
ALTERNATIVES:
If City Council does not approve this Ordinance, the current zoning would remain.
Upon request of City Council, the Ordinance could be returned to the Planning and Zoning
Commission for consideration of proposed modifications.
RECOMMENDATION:
Approval of the Ordinance.

RESIDENTIAL AND OFFICE DISTRICT TO B-3, HIGHWAY
AND ARTERIAL BUSINESS DISTRICT
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The zoning restrictions covering the following described property and generally
identified in the attached Rezone Exhibit is hereby changed from R-5, Multiple Residential
and Office District to B-3, Highway and Arterial Business District:
LOT 1 BLK 1 ZION FILING #1 FORMERLY #15-091-00-002+15-091-19-002+007+
½ of Pueblo Blvd ROW
PARCEL SIZE: 5.74 ACRES
SECTION 2.
The officers and staff of the City are directed to perform any and all
authorized and
acts consistent with the intent of the Ordinance to the policies and procedures
implement
described herein.
SECTION 3.
This Ordinance shall become effective immediately upon final passage and
approval.
