HomeMy WebLinkAbout09290ORDINANCE NO. 9290 AN ORDINANCE CHANGING ZONING RESTRICTIONS TH FOR A PARCEL OF LAND LOCATED AT 1526 W 17 STREET FROM R-2, SINGLE FAMILY RESIDENTIAL DISTRICT TO R-3, ONE AND TWO FAMILY RESIDENTIAL ZONE DISTRICT BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering the following described property and generally identified in the attached Rezone Exhibit is hereby changed from R-2, Single Family Residential District to R-3, One- and Two-Family Residential District: Lots 5, 6, 7 and the west 8 feet 4 inches of Lot 8, Block 21, Irving Place Addition. Together with: th The south half of 17 Street, adjacent thereto and the north half of alley way of Block 21, adjacent thereto. Total rezoned area contains 0.32 Acres, more or less. SECTION 2. The zoning is approved with the following conditions: 1. Complete landscape improvements in compliance with Section 17-4-7 of the Pueblo Municipal Code. 2. Public improvements, parking lot improvements, detention and water quality improvements shall be completed in compliance with the Pueblo Municipal Code. th 3. Retain access to the site from the alley – no access permitted from W. 17 Street. SECTION 3. The officers and staff of the City are authorized and directed to perform any and all acts consistent with the intent of the Ordinance to implement the policies and procedures described herein. SECTION 4. This Ordinance shall be approved upon final passage but shall not become effective until the conditions, if any, approved by City Council, have been completed and approved by the Director of Public Works. If for any reason such conditions are not completed and approved within one (1) year after final passage of this Ordinance, or within any extended period granted by Resolution of the City Council, this Ordinance shall automatically be rescinded and repealed thirty (30) days after written notice of such rescission and repeal is given to the Owner. No vested rights shall accrue to the rezoning or be acquired until this Ordinance becomes effective. Nicoll and Members of City Council CC: Sam Azad, City Manager VIA: Brenda Armijo, Acting City Clerk FROM: Steven Meier, Director of Planning and Community Development SUBJECT: AN ORDINANCE CHANGING ZONING RESTRICTIONS FOR A PARCEL TH OF LAND LOCATED AT 1526 WEST 17 STREET FROM R-2, SINGLE FAMILY RESIDENTIAL DISTRICT TO R-3, ONE AND TWO FAMILY RESIDENTIAL ZONE DISTRICT SUMMARY: The applicant is requesting to rezone the subject property from R-2 to R-3, One and Two Family Residential District PREVIOUS COUNCIL ACTION: None. BACKGROUND: th The owner of the property located at 1526 West 17 Street is requesting to rezone the property from R-2 to R-3 to utilize the property for a parking lot. The proposed use is not permitted in the existing R-2 Zone District; however, it is allowed with a Special Use Permit in the R-3 Zone District as a Parking Lot. Redevelopment of the property that requires a Special Use Permit or a Building Permit will need to be completed in compliance with the Pueblo Municipal Code. FINANCIAL IMPLICATIONS: There are no financial implications for the City. BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission, at their October 11, 2017 Regular Meeting, voted 7-0 to recommend approval with the following conditions: 1. Provide the following landscape improvements, and provide a landscape plan that is approved by staff prior to being scheduled for City Council: a. Provide full landscaping according to Section 17-4-7 of the Pueblo Municipal Code. 2. Public improvements and parking lot improvements will be required at the time of development. 3. Detention and water quality will be required at the time of development. th 4. Retain access to the site from the alley – no access permitted from West 17 Street. The recommended conditions of approval from Planning and Zoning Commission have been revised in the Ordinance to reflect the removal of the requirement to provide plans prior to being scheduled for City Council. STAKEHOLDER PROCESS: The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing to all property owners located within 300 feet of the subject property. A Public Notice poster was placed on the subject property 15 days prior to the Public Hearing. ALTERNATIVES: If City Council does not approve this Ordinance, the current zoning would remain. Upon request of City Council, the Ordinance could be returned to the Planning and Zoning Commission for consideration of proposed modifications. RECOMMENDATION: Approval of the Ordinance.
