HomeMy WebLinkAbout09285 ORDINANCE NO. 9285 AN ORDINANCE EXCLUDING THE WEST LEE HILLS SUBDIVISION, FORMERLY KNOWN AS THE REGENCY PARK WEST ANNEXATION AND A PORTION OF THE HUDSPETH ANNEXATION, FROM THE BANDERA BOULEVARD SPECIAL IMPROVEMENT MAINTENANCE DISTRICT BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The City Council finds and determines that on April 9, 2018, a “Petition to Exclude” signed by a majority of persons who own real property in the West Lee Hills Subdivision, formerly the Regency Park West Annexation and a portion of the Hudspeth Annexation, was filed with the City Clerk for purposes of excluding certain real property located within the Bandera Boulevard Special Improvement Maintenance District. The City Council further finds and determines that due and proper notice of the hearing on this Ordinance was published in The Pueblo Chieftain and that a notice of hearing on this Ordinance was mailed to the owners of property located within the West Lee Hills Subdivision. SECTION 2. The area known as the West Lee Hills Subdivision, formerly known as the Regency Park West Annexation and a portion of the Hudspeth Annexation, having the following legal description: The West Lee Hills Subdivision Plat, recorded in the records of the Pueblo County Clerk and Recorder on April, 2018, at Reception No. 1616742, located in the NW ¼ less the E ½ E ½ NW ¼ of Section 9, Township 21 South, Range 65 West of th the 6 P.M., County of Pueblo, State of Colorado and the parcels listed on Exhibit A attached hereto and incorporated herein by reference, shall be and hereby are excluded from the Bandera Boulevard Special Improvement Maintenance District. SECTION 3. The officers and staff of the City are authorized and directed to perform any and all acts consistent with this Ordinance which are necessary or desirable to implement same. SECTION 4. This Ordinance shall become effective immediately upon final passage. . Nicoll and Members of City Council CC: Sam Azad, City Manager VIA: Brenda Armijo, Acting City Clerk FROM: Steven Meier, Director of Planning and Community Development SUBJECT: AN ORDINANCE EXCLUDING THE WEST LEE HILLS SUBDIVISION, FORMERLY KNOWN AS THE REGENCY PARK WEST ANNEXATION AND A PORTION OF THE HUDSPETH ANNEXATION, FROM THE BANDERA BOULEVARD SPECIAL IMPROVEMENT MAINTENANCE DISTRICT SUMMARY: Attached is an Ordinance which changes the boundaries of the Bandera Boulevard Special Improvement Maintenance District (“Bandera District”) to exclude the West Lee Hills Subdivision, formerly known as the Regency Park West Annexation and a portion of the Hudspeth Annexation (“WLH Subdivision”). PREVIOUS COUNCIL ACTION: On September 22, 2003 by Ordinance No. 7048, the City Council created the Bandera District. BACKGROUND: C.R.S. 31-25-618 and Section 12-9-12 of the Pueblo Municipal Code permit the owners of real property located within a Special Improvement District in a municipality, which provides maintenance of public improvements, to file a petition to be excluded from the District. A petition, signed by more than half of the property owners in the WLH Subdivision, has been filed with the City Clerk for the purpose of changing the boundaries of the Bandera District, so as to exclude the WLH Subdivision from the Bandera District. The District was formed to generate funding through an assessed property tax or mill levy for the maintenance of the landscaping in the Bandera Boulevard right of way. The District generated revenue in the amount of approximately $22,850.00 in 2017. The portion of Bandera Boulevard adjacent to the WLH Subdivision will not be built in the near foreseeable future. The tax generated in this subdivision in 2017 at 3 mills was in the amount of $4,255.01. FINANCIAL IMPLICATIONS: There will be no direct financial impact on the City. The Bandera District will lose property tax revenue if this Ordinance is approved. BOARD/COMMISSION RECOMMENDATION: Not applicable. STAKEHOLDER PROCESS: No applicable. ALTERNATIVES: The petitioners seeking exclusion from the Bandera District have complied with the requirements of State law and the Pueblo Municipal Code. Therefore, there is no legal basis for failing to approve this Ordinance. RECOMMENDATION: Staff recommends approval of this Ordinance.
