ORDINANCE NO. 9268
AN ORDINANCE DESIGNATING THE BLACK HILLS 5 & 6
POWER PLANT, 105 SOUTH VICTORIA, AS A LOCAL
HISTORIC LANDMARK
WHEREAS, the City of Pueblo's Historic Preservation Code, Chapter 14, Title
IV, declares that the City shall identify, designate and preserve those buildings, objects,
monuments, structures and sites which reflect outstanding elements of the
community's architectural and cultural heritage; and
WHEREAS, the present application was initiated by the Historic Preservation
Commission, and the City's Historic Preservation Commission has reviewed the
application for designation of The Black Hills 5&6 Power Plant as a Local Historic
Landmark and has recommended to the Planning and Zoning Commission the
designation of this resource; and
WHEREAS, the City Planning and Zoning Commission has reviewed the Historic
Preservation Commission's recommendation and the designation application and
submitted its recommendation thereon for landmark designation to Council; NOW
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The City Council finds and determines that the Building Envelope of The Black
Hills 5&6 Power Plant located at 105 South Victoria Avenue, Pueblo, Colorado, located
within Lots 10 to 14 and Lots 19-24, Block 30 CC&I, COS ADDITION #2, having the
legal description set forth in Exhibit A, attached hereto and incorporated herein by
reference (hereinafter "local Pueblo Historic Landmark") is associated with the life of a
person significant in the past, and embodies those distinguishing characteristics of an
architectural type or engineering specimen; as defined in the Pueblo Historic
Preservation Code Section 4-14-8.
SECTION 2.
The City Council hereby designates the Building Envelope of The Black Hills 5&6
Power Plant as a local Pueblo Historic Landmark, subject to the benefits, obligations
and restrictions resulting from such designation as described in Chapter 14, Title IV of
the Pueblo Municipal Code.

FOR
BLACK HILLS ENERGY CORPORATION
A building envelope description of land located in a the northeast one-
quarter of Section 36, Township 20 South, Range 65 West of the 6th P.M. in
the County of Pueblo and State of Colorado, being a portion of Block 30 in
Colorado Coal & Iron Company's Addition No. 2 and more particularly
described as follows.
Considering a line between the centerline monument line for the
intersection of Victoria Avenue and B Street monumented with an
aluminum cap in a survey monument box and the centerline monument for
the intersection of Victoria Avenue and Greenwood Street monumented
with an aluminum cap in a survey monument box; to bear N. 44°42'37" E.,
and all bearings contained herein being relative thereto.
Beginning at the most westerly point on the westerly line of Parcel A, Block
1, in Historic Arkansas Riverwalk Project, Filing One, according to the
recorded plat thereof, as filed for record at Reception No. 1289663 in the
Pueblo County records; thence S. 78°10'48" E. along the westerly line of
said Parcel A, a distance of 82.98 feet; thence S. 45°03'31" E., a distance
of 156.60 feet; thence S. 44°40'35" W., a distance of 135.00 feet; thence N.
45°16'22" W.; a distance of 286.18 feet; thence N. 32°37'40" E.; a distance

SUBJECT: AN ORDINANCE DESIGNATING THE BLACK HILLS 5 & 6 POWER PLANT, AS
A LOCAL PUEBLO HISTORIC LANDMARK
SUMMARY:
This Ordinance designates The Black Hills 5&6 Power Plant as a local Pueblo Historic Landmark,
pursuant to the Historic Preservation Code, Chapter 14, Title IV of the Pueblo Municipal Code.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
The power plant delivered power beginning in 1888. It is an example of the Art Deco Industrial
with Modern Movements. The structure anchors the northwestern end of the Historic Arkansas
River Project (HARP) and is adjacent to the Union Avenue Historic District, which contains a
number of buildings on the National Register of Historic Places. To qualify as a historic landmark
in the City of Pueblo, a property must be eligible under certain criteria (historic, architectural,
and/or geographic). City Council will determine, at this public meeting, whether this landmark
application complies with the rules for designation according to municipal code (Sec. 4-14-8). The
applicant claims that the Black Hills Power Plant 5 & 6 is eligible under the following:
History-1a
: Have direct association with the historical development of the city, state, or
nation.
History 1b:
Be the site of a significant historic event (such as during the flood of 1921).
Architecture-2a
: Embody distinguishing characteristics of an architectural style or type.
Architecture2b
-: Be a significant example of the work of a recognized architect or master
builder.
Architecture-2c
: Contain elements of architectural design, engineering, materials,
craftsmanship, or artistic merit which represent a significant or influential innovation.
Geography-3a
: Have a prominent location or be an established, familiar, and orienting
visual feature of the contemporary city.
FINANCIAL IMPLICATIONS:
The financial impact associated with this designation has been in question since the beginning
of the decommissioning of the Black Hills 5&6 Plant. The history of the plans for saving the
building included requests by the City to advertise for proposals for the adaptive reuse of the
building in lieu of demolition. Black Hills agreed to the request and stayed demolition for several
months while adaptive reuse offers were solicited. The Request for Proposals was advertised.
One offer was received but did not meet the criteria to be acceptable as complete. Black Hills
then offered the building to the City. The City declined due to lack of resources to properly
maintain the structure and its environmental issues until a developer could be found. Black Hills
was given the go ahead to proceed with preparation for demolition which required abatement of
several items within the structure. The demolition permit was brought to City Planning and the
routing sheet was signed. Black Hills then completed the required abatement requirement and
filed for a demolition permit with Pueblo Regional Building. Before Regional Building could issue
the permit an application for Landmark Designation was submitted by the Historic Preservation
Commission. According to Pueblo HPC procedures an application for Landmark would stay the
demolition of the structure. The demolition permit was then withheld as procedure dictates.
Black Hills Energy has indicated that further delays would be met with litigation in District Court
if City Council approves the Landmark designation.
BOARD/COMMISSION RECOMMENDATION:

The City of Pueblo Historic Preservation Commission voted unanimously on March 10, 2016 to
approve the recommendation for Landmark. The City of Pueblo Planning and Zoning

Commission voted 4-2 on April 13, 2016 in favor of the recommendation.
STAKEHOLDER PROCESS:
The Historic Preservation and Planning and Zoning Commissions each conducted public hearings
to receive comments on the request for historic designation as part of their required process.
ALTERNATIVES:
The Black Hills 5&6 will not be designated as local Pueblo Historic Landmark.
RECOMMENDATION:
Staff will defer recommendation to City Council regarding the Landmark designation of Black Hills
5&6.
