Nicoll andMembers of City Council CC: Sam Azad, City Manager VIA: Brenda Armijo, Acting City Clerk From: Nancy Keller, Wastewater Director SUBJECT: AN EMERGENCY ORDINANCE APPROVING THE TRANSFER AND COMBINING OF BUDGETED AND APPROPRIATED WASTEWATER FUNDS FROM EXISTING PROJECTS IN ORDER TO MORE EFFICIENTLY COMPLETE ONE LARGE CONSTRUCTION PROJECT, TRANSFERRING AND APPROPRIATING FUNDS FROM (WW1303) GRAVITY THICKENER, AND (WWAN04) TREATMENT PLANT REHAB/EQUIPMENT, IN THE TOTAL AMOUNT OF $2,225,000, TO (WW1706) 2017 PROCESS IMPROVEMENTS SUMMARY: This Emergency Ordinance approves transferring funds, already budgeted and appropriated, from two existing projects to one existing project. PREVIOUS COUNCIL ACTION : Resolution No.13722, passed on July 10, 2017, created (WW1706) 2017 Process Improvements. Resolution No. 12630, passed on March 25, 2013, created (WW1303) Gravity Thickener. Each year through the budget process, an amount is budgeted and appropriated for the (WWAN04) WRF Treatment Plant – Annual Facility Repair & Rehabilitation. BACKGROUND : In March of 2013 the Gravity Thickener Project (WW1303) was established and funded with $1,200,000 to update and improve processing at the James R. DiIorio Water Reclamation Facility. This project has not been done due to cost. Other process changes in the plant have reduced the current need. The gravity thickener is thirty years old and will need to be addressed when funds are available. Each year funds are budgeted in a projected titled WRF Treatment plant – Annual Facility Repair & Rehabilitation (WWAN04) to replace heavy machinery and equipment for wastewater treatment, as needed to maintain proper operation of the facility. There is currently approximately $1,800,000 available in this project. A portion of the funds from this project and funds budgeted for the Gravity Thickener Project (WW1303), will be combined with existing funds in the project titled 2017 Process Improvements (WW1706) to more efficiently provide needed upgrades to the James R. DiIorio Water Reclamation Facility. FINANCIAL IMPLICATIONS : Funds are available from the Sewer User Funds and have been previously budgeted and appropriated. This will combine funds to create more efficiency with one construction project. BOARD/COMMISSION RECOMMENDATION : Not applicable STAKEHOLDER PROCESS : None ALTERNATIVES : Alternative No. 1 – No Action In the event of no action being taken, the awarding of a construction project will be delayed. The digester could potentially fail and nutrient reductions may not be met prior to the date required in the Colorado Discharge Permit. This could lead to the inability to sufficiently treat wastewater and cause the City to be in noncompliance of state requirements and cause serious health and safety issues to the public. RECOMMENDATION : Approval of the Emergency Ordinance. ORDINANCE NO. 9267 AN EMERGENCY ORDINANCE APPROVING THE TRANSFER AND COMBINING OF BUDGETED AND APPROPRIATED WASTEWATER FUNDS FROM EXISTING PROJECTS IN ORDER TO MORE EFFICIENTLY COMPLETE ONE LARGE CONSTRUCTION PROJECT, TRANSFERRING AND APPROPRIATING FUNDS FROM (WW1303) GRAVITY THICKENER, AND (WWAN04) TREATMENT PLANT REHAB/EQUIPMENT, IN THE TOTAL AMOUNT OF $2,225,000, TO (WW1706) 2017 PROCESS IMPROVEMENTS WHEREAS, The City of Pueblo, each year, has budgeted and appropriated funds for a number of projects in Wastewater; and WHEREAS, the Treatment Plant–Annual Facility Repair & Rehabilitation project (WWAN04) was created, and funded each year, to replace heavy machinery and equipment for wastewater treatment as needed; the current available budget is $1,800,000, transferring $1,025,000 of this balance to Project (WW1706) will leave a balance of approximately $775,000 in (WWAN04) for emergencies; and WHEREAS, the Gravity Thickener project (WW1303) was created and funded with a total budget of $1,200,000, and it has been determined that this particular project does not need to be performed at this time, leaving a remaining balance of $1,200,000; and WHEREAS, the addition of the aforementioned budgets into the 2017 Process Improvements Project (WW1706), will allow for the ability to award a contract for much needed upgrades and rehabilitation at the James R. DiIoriio Water Reclamation Facility; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The City hereby transfers and appropriates a budget amount of $1,025,000 from the Treatment Plant–Annual Facility Repair & Rehabilitation project (WWAN04) to the 2017 Process Improvements Project (WW1706). SECTION 2. The City hereby closes the Gravity Thickener project (WW1303), and transfers and appropriates the budget of $1,200,000, to the 2017 Process Improvements Project (WW1706). SECTION 3. The City Council finds that this Ordinance qualifies for treatment as an emergency ordinance pursuant to City Charter because the deteriorated condition of digester lid. An emergency repair was done on the lid in 2016 to repair a hole in the lid. This project must be started soon to allow the work to be completed and the digester to be brought back online prior to any cold weather. Without this digester properly functioning the process will be severely compromised. This emergency ordinance is required to maintain compliance with the Colorado Discharge Permit and for the immediate protection of public health, safety and property of the residents of the City of Pueblo as well as for compliance with the Colorado Discharge Permit. SECTION 4. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Ordinance to effectuate the transactions described therein. SECTION 5. This Ordinance shall become effective immediately upon passage and approval.
