ORDINANCE NO. 9263
AN ORDINANCE VACATING A WATER METER EASEMENT AND
A DRAINAGE POND EASEMENT WITHIN THE GRUMA
SUBDIVISION
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The following easements:
To vacate certain easements within Lot 1, Gruma Subdivision, according to the recorded
plat thereof, filed for record December 17, 2014, as Reception No. 1992317 in the records
of the Pueblo County Clerk and Recorder, located within a portion of the W 1/2 of Section
31, Township 20 South, Range 64 West of the Sixth Principal Meridian, being more
particularly described as follows:
All of the 5' x 5'Water Meter Easement within said Lot 1, Gruma Subdivision.
Said Vacated Water Meter Easement contains 25± s.f.
AND
All of the Detention Pond Easement within said Lot 1, Gruma Subdivision.
Said Vacated Detention Pond Easement contains 4860± s.f.
is hereby vacated.
SECTION 2.
The officers and staff of the City are authorized and authorized to perform any and all acts
consistent with the intent of this Ordinance to effectuate the policies and procedures described
herein.
SECTION 3.
This Ordinance shall be approved but shall not become effective until the final vacation
plat is recorded in the office of the Pueblo County Clerk and Recorder. If the vacation plat is not
recorded within one (1) year after of this Ordinance, or within any extended period granted by
Ordinance of the City Council, this Ordinance shall automatically be rescinded and repealed thirty
(30) days after written notice of such rescission and repeal is given to the applicant. No vested
rights shall accrue to the subdivision or be acquired until this Ordinance becomes effective.

SUBJECT: AN ORDINANCE VACATING A WATER METER EASEMENT AND A DRAINAGE
POND EASEMENT WITHIN THE GRUMA SUBDIVISION
SUMMARY:
The applicant is requesting to vacate a water meter easement at the west property line, adjacent
to Santa Fe Avenue and north of Gruma Drive, within Lot 1, Gruma Subdivision and all of the
detention pond easement, north of Gruma Drive, within Lot 1, Gruma Subdivision.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
The applicant is requesting a vacation of the five foot (5’) by five foot ( 5’) water easement on the
west side of the property adjacent to Santa Fe Avenue and north of Gruma Drive, as well as the
detention pond easement north of Gruma Drive. The re-subdivision will include an interior water
meter as part of the proposed improvements for the property. The existing water meter easement
will become part of the property used for the construction of the new Townplace Suites Hotel.
The vacation of the water meter easement and detention pond easement is necessary to
accommodate the placement of the proposed hotel building.
FINANCIAL IMPLICATIONS:
There are no financial implications for the City.
BOARD/COMMISSION RECOMMENDATION:
The Planning and Zoning Commission, at their March 14, 2018 Regular Meeting, voted 7-0 to
recommend approval.
STAKEHOLDER PROCESS:
The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing
to all property owners located within 300 feet of the subject property.
A Public Notice poster was placed on the subject property 15 days prior to the Public Hearing.
ALTERNATIVES:
If City Council does not approve this Ordinance, the current subdivision would remain and would
impede the applicant’s ability to develop the property.
Upon request of City Council, the Ordinance could be returned to the Planning and Zoning
Commission for consideration of proposed modifications.
RECOMMENDATION:
Approval of the Ordinance.
