HomeMy WebLinkAbout09257 ORDINANCE NO. 9257 AN EMERGENCY ORDINANCE TRANSFERRING, BUDGETING AND APPROPRIATING, $270,543.05 TO PROJECT CI1709 THE PUEBLO ZOO ECO CENTER (PENGUIN EXHIBIT) ROOF REPLACEMENT PROJECT WHEREAS, Weathercraft Company of Colorado Springs, was awarded a Contract for project No. 17-082 Pueblo Zoo ECO Center (Penguin Exhibit) Roof Replacement; NOW, THEREFOR, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Funds in the amount of $270,543.05 are hereby transferred from Project CI1502 Roof Replacements to Project No. CI1709 – Pueblo Zoo ECO Center (Penguin Exhibit) Roof Replacement Project. SECTION 2. An increase of $270,543.05 is hereby budgeted and appropriated for Project No. CI1709 – Pueblo Zoo ECO Center (Penguin Exhibit) Roof Replacement Project. SECTION 3. The City Council finds that this Ordinance qualifies for treatment as an emergency ordinance pursuant to City Charter because the deteriorated condition of the existing roof for the Penguin Exhibit within the Pueblo Zoo ECO Center. This emergency ordinance is required for the immediate protection of public health, safety and property of the residents of the City of Pueblo. SECTION 4. The Purchasing Agent is hereby authorized to execute said contract on behalf of Pueblo, a Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and attest the same. SECTION 5. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Ordinance and the attached Letter to implement the transactions described therein. SECTION 6. This Ordinance shall become effective immediately upon final passage and approval. Nicoll and Members of City Council CC: Sam Azad, City Manager VIA: Brenda Armijo, Acting City Clerk FROM: Jeff Bailey, Acting Public Works Director SUBJECT: AN EMERGENCY ORDINANCE TRANSFERRING, BUDGETING, AND APPROPRIATING $270,543.05 TO PROJECT CI1709 THE PUEBLO ZOO ECO CENTER (PENGUIN EXHIBIT) ROOF REPLACEMENT PROJECT SUMMARY: This Emergency Ordinance will budget and appropriate an increase of additional funds and transfers those funds to account CI1709 – Pueblo Zoo ECO Center (Penguin Exhibit) Roof Replacement for unforeseen required work. PREVIOUS COUNCIL ACTION: On November 27, 2017, City Council approved Resolution 13830 awarding the construction contract to Weathercraft Company of Colorado Springs in the amount of $106,950 with $11,000 contingencies for the Pueblo Zoo ECO Center (Penguin Exhibit) roof replacement. BACKGROUND: The original project consisted of the demolition of the existing roofing and installation of new roofing material. Just after the contractor began work of removing the roofing material around the skylights it was discovered the curbing material that supports the skylights have deteriorated beyond usability and requires replacement. Crenshaw Consulting Group, Inc., Roof Consultant for the City of Pueblo, was requested to provide a change order to replace the skylights and curbing along with additional costs associated with the work to be performed. Additional funds will cover the additional work. FINANCIAL IMPLICATIONS: Funds in the amount of $270,543.05 from the Account CI1502 Roof Replacements shall be transferred into Project Number CI1709 – Pueblo Zoo ECO Center (Penguin Exhibit) Roof Replacement. Project total has increased from $117,950 to $388,493.05. BOARD/COMMISSION RECOMMENDATION: None. STAKEHOLDER PROCESS: None ALTERNATIVES: Denying the Ordinance will result in cancellation of the construction contract. This will require the contractor to seal up areas that was removed during startup and return the new roofing material to the manufacture which will cost the City restocking fees. The contractor will also be able to bill for mobilization and some minor work. RECOMMENDATION: Approval of the Emergency Ordinance. Attachment: Change order option sheet
