HomeMy WebLinkAbout09238ORDINANCE NO. 9238 AN ORDINANCE APPROPRIATING FUNDS FROM THE GENERAL FUND, FUND BALANCE, TO MUNICIPAL COURT IN THE AMOUNT OF $39,000.00 TO HIRE TWO PART-TIME TEMPORARY PROBATION OFFICERS WHEREAS, Municipal Court currently does not have an adult diversion program; and WHEREAS, Municipal Court offenders and the public will benefit from the development of an adult diversion program; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Funds in the amount of $39,000.00 are hereby appropriated from the General Fund, Fund Balance, to Municipal Court for the hiring of two part-time temporary probation officers. SECTION 2. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Ordinance to effectuate the policies and procedures described herein. SECTION 3. This Ordinance shall become effective immediately after final passage and approval. Nicoll and Members of City Council CC: Sam Azad, City Manager VIA: Brenda Armijo, Acting City Clerk FROM: Carla Sikes, Municipal Court Judge SUBJECT: AN ORDINANCE APPROPRIATING FUNDS FROM THE GENERAL FUND, FUND BALANCE, TO MUNICIPAL COURT IN THE AMOUNT OF $39,000.00 TO HIRE TWO PART-TIME TEMPORARY PROBATION OFFICERS SUMMARY: Pueblo Municipal Court seeks to improve its diversion programs with the addition of adult probation. PREVIOUS COUNCIL ACTION: There has been no previous City Council action with regards to this Ordinance. BACKGROUND: Municipal Court has a strong juvenile diversion program, which includes supervised juvenile probation. One full-time Probation Supervisor and one part-time temporary Probation Officer manage and supervise all juvenile probation and deferred cases. Probation tracks a juvenile’s progress and compliance with court orders. This may include meeting with the juvenile regularly, coordinating treatment with outside agencies, working with the Department of Human Services, communicating with schools, and tracking community service. Many adult offenders would benefit from treatment and services and other alternative sentencing. Currently, Municipal Court does not have sufficient staff to track adult offenders’ progress and compliance. The addition of two part-time temporary probation officers will allow the Municipal Court to initiate an adult diversion program to include supervised probation. This would address the underlying issues rather than simply punishing the illegal act, which will help to reduce recidivism. FINANCIAL IMPLICATIONS: Part-time temporary probation officers are paid at the rate of $15.00 per hour, with the total number of hours limited to 1300 annually. The total cost to hire two part-time temporary probation officers is $39,000.00. If approved, the funds will be appropriated from the General Fund, Fund Balance, to Municipal Court. BOARD/COMMISSION RECOMMENDATION: Not applicable. STAKEHOLDER PROCESS: Not applicable. ALTERNATIVES: Deny the appropriation of funds. Municipal Court will not develop an adult diversion program.
