AN ORDINANCE DISCONNECTING PROPERTY FROM THE
CITY OF PUEBLO COMMONLY KNOWN AS THE PUEBLO
SPRINGS RANCH "LARIAT", GENERALLY DESCRIBED AS
362.802 ACRES OF LAND EAST OF INTERSTATE 25, SOUTH
OF THE PUEBLO/EL PASO COUNTY LINE, AND NORTH OF
COLORADO STATE UNIVERSITY-PUEBLO AND PUEBLO
MEMORIAL AIRPORT PREVIOUSLY ANNEXED BY THE CITY
ON JANUARY 28, 2008 BY ORDINANCE NO. 7732 THROUGH
7738
WHEREAS, on October 22, 2007 City Council approved Resolution No. 13671 accepting
a Warranty Deed and Right of Reversion between the City of Pueblo and Pueblo Springs Ranch,
LLC, a Nevada Limited Liability Company. Said deed was recorded on November 8, 2008 at
Reception No. 1748310 of the records of the Pueblo County Clerk and Recorder; and,
WHEREAS, said deed conveyed to the City a "Lariat" of approximately 362.802 acres of
land surrounding the proposed Pueblo Springs Ranch development ("Property"); and,
WHEREAS, on January 28, 2008, by Ordinance No. 7732 through 7738, the Pueblo City
Council annexed the approximately 362.802 acres of City-owned land comprising the "Lariat" in
a series of seven (7) annexation phases; and,
WHEREAS, Section 3 of said deed provided for a "triggering event" requiring the City to
re-convey the"Lariat", and disconnect said Property from the corporate limits of the City of Pueblo
if the Pueblo Springs Ranch property (internal to the "Lariat") was not annexed into the City of
Pueblo by December 31, 2008; and,
WHEREAS, by agreement of the parties, the date of the "triggering event" was extended
six (6) times, as follows:
1. A fully executed Modification Agreement (No. 1) dated December 31, 2007 and recorded
on January 23, 2008 at Reception No. 1755620 of the records of the Pueblo County Clerk
and Recorder;
2. A fully executed Modification Agreement (No. 2) dated December 22, 2008 and recorded
on January 14, 2009 at Reception No. 1792907 of the records of the Pueblo County Clerk
and Recorder;
3. A fully executed Modification Agreement (No. 3) dated January 11, 2010 and recorded on
February 17, 2010 at Reception No. 1833476 of the records of the Pueblo County Clerk
and Recorder;
4. A fully executed Modification Agreement(No. 4) dated January 24, 2011, expiring January
31, 2013, and recorded on April 1, 2011 at Reception No. 1871515 of the records of the
Pueblo County Clerk and Recorder; and,
5. A fully executed Modification Agreement (No. 5) dated January 28, 2013, expiring January
31, 2014, and recorded on May 16, 2013 at Reception No. 1943231 of the records of the
Pueblo County Clerk and Recorder; and,
6. A fully executed Modification Agreement (No. 6)dated January 27, 2014, expiring January
31, 2017, and recorded on February 12, 2014 at Reception No. 1967421 of the records of
the Pueblo County Clerk and Recorder; and,

WHEREAS, the "triggering event" was not extended beyond the January 31, 2017 date
established in the fully executed Modification Agreement dated January 27, 2014, thereby
requiring the City to re-convey the "Lariat", and disconnect said Property from the corporate limits
of the City of Pueblo; and,
WHEREAS, pursuant to §31-12-501 C.R.S., the City Council has the authority to
disconnect land within and adjacent to the corporate boundary of the City; NOW THERFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The following described area situated within the City of Pueblo, Colorado, is hereby
disconnected from the corporate limits of the City, and the official map of the City shall be
amended to show such disconnection:

SECTION 3.
The City Council hereby finds and determines that the City owns the area to be
disconnected.
SECTION 4.
Ordinances No. 7732, 7733, 7734, 7735, 7736, 7737, and 7738 are hereby rescinded.
SECTION 5.
Within thirty (30) days after the effective date of the Ordinance, the Acting City Clerk shall:
(a) File one copy of the disconnection maps with the original of this Ordinance in the office
of the City Clerk;
(b) File for recording three certified copies of this Ordinance and disconnection map with
the Pueblo County Clerk and Recorder;
(c) File one certified copy of the disconnection map and this Ordinance with the
Southeastern Colorado Water Conservancy District.
SECTION 6.
The officers and staff of the City are authorized and directed to perform any and all acts
consistent with the intent of the Ordinance to implement the policies and procedures described
herein.
SECTION 7.
This Ordinance shall become effective immediately upon final passage.

SUMMARY:
Attached for consideration is an Ordinance approving the disconnection of the Pueblo Springs
Ranch “Lariat” property owned by the City of Pueblo containing 362.802 acres from the corporate
limits of the City.
PREVIOUS COUNCIL ACTION:
City Council approved the acceptance of a Warranty Deed and Right of Reversion dated October
22, 2007 between the City of Pueblo and Pueblo Springs Ranch, LLC for the 362.802 acres of
property commonly known as the Pueblo Springs Ranch “Lariat” (“Property”). The Property was
annexed into the City on January 28, 2008 as a series annexation by Ordinance No. 7732 through
7738.
BACKGROUND:
Subject to the terms of the Warranty Deed and Right of Reversion dated October 22, 2007
between the City of Pueblo is disconnecting the Property from the corporate limits of the City in
accordance with the requirements of the Colorado Revised Statutes. Following the disconnection
of the Property, and the approval of an agreement between the City and the three owners of the
balance of the Pueblo Springs Ranch property, the City will convey the Lariat Property back to
the property owners.
FINANCIAL IMPLICATIONS:
The City will no longer have any financial commitments for the Property after it is transferred back
to the Pueblo Springs Ranch property owners.

Not applicable.
STAKEHOLDER PROCESS:
Not applicable.
ALTERNATIVES:
If City Council does not approve this Ordinance, the subject property would remain within
corporate limits of the City, and will not comply with the Right of Reversion in the Warranty Deed
dated October 22, 2007.
