HomeMy WebLinkAbout09225ORDINANCE NO. 9225 AN ORDINANCE ESTABLISHING AN APPROVED LIST OF CONTRACTORS TO PERFORM EMERGENCY STORM SEWER POINT REPAIRS DURING CALENDAR YEARS 2018 AND 2019 AND AUTHORIZING THE PURCHASING AGENT TO EXECUTE CONTRACTS WITH THE LOWEST BIDDER FROM SUCH LIST WHEREAS, proposals for performing storm sewer point repairs under Project No. 17-090 have been received and examined, and; WHEREAS, the proposals from K.R. Swerdfeger Construction, Inc., and Parker Excavating, Inc., (collectively the “Approved List”) have been determined to be responsive; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Council hereby authorizes, subject to an unexpended balance of appropriations therefore, that upon approval of the City Manager or Mayor, as applicable at time of execution, contracts for effecting emergency storm sewer point repairs may be awarded from time to time, to the lowest bidder on the Approved List, as determined by unit prices for elements of construction submitted by responsive bidders under Project No. 17-090, based on the requirements and unit quantities of each repair project as may arise, and that the same be awarded to said bidder in the required amount at the time of each project. SECTION 2. Funds for Project 17-090 (SW1501) shall be from the “Stomwater Point Repairs and Pipe Cleaning” capital project budget funded by the Stormwater Utility Enterprise. SECTION 3. Upon approval of the City Manageror Mayor, as applicable at time of execution, the Purchasing Agent is hereby authorized to execute said contract on behalf of Pueblo, a Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and attest the same. Any such contract shall be submitted to the City Council for ratification and approval. SECTION 4. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Ordinance and the contract to effectuate the transactions described therein. SECTION 5. This Ordinance shall become effective immediately upon passage and approval. Since the established list will be utilized upon approval of the City Manager or Mayor, as applicable at time of execution, this Ordinance has been modified to reflect such. PREVIOUS COUNCIL ACTION : None BACKGROUND : The City of Pueblo owns and operates a storm sewer system for the purpose of conveying stormwater to the downstream rivers which the system is tributary to and where they outfall. Portions of the storm sewer system are more than 100 years old and were constructed using clay tile, corrugated metal, and brick pipe. From time to time, the City discovers broken pipes or obstructions in pipes that cannot be cleared. In such emergency cases, point repairs must be made in an expeditious manner by excavating and replacing the damaged storm sewer pipes. Storm sewer problems requiring point repairs are most often discovered when residents report problems such as sinkholes and storm sewer backups. Due to this fact, it is often not possible to anticipate when and where point repairs will be needed. Between the time that the problem occurs and the time it is repaired, properties in the vicinity and the general public may be at risk of health and safety issues, along with flooding from backups. As a result, it is in the best interest of the community that storm sewer point repairs be completed as rapidly as possible after discovery. The City of Pueblo normally requires competitive bids for construction projects in order to assure that costs are controlled. The City also has provisions that allow the City Manager to approve emergency construction projects without bidding and without prior City Council approval. This Resolution, authorizing contracts under 2018 and 2019 Storm Sewer Point Repair 17-090, will provide both competitive bid cost controls and rapid response capability by establishing a list of qualified contractors who have provided a list of unit prices. The Purchasing Department solicited unit cost competitive bids from contractors for various elements of storm sewer point repair, including per-linear-foot pipe replacement costs for differing pipe sizes and depths, unit costs for manholes, unit costs for curb-and- gutter repair, and mobilization costs. Two bids were received. A bid summary sheet is attached. The two responsive bidders form a list of qualified firms to whom point repair projects can be offered. When a point repair project arises, Stormwater Department staff will evaluate the repairs needed, determine the unit quantities for the work required and determine which of the qualified vendors would be able to complete the repairs at the lowest cost by using the unit prices provided by each vendor in their bid. The point repair will then be offered to the vendor providing the lowest cost. The vendor will be required to sign a standard City construction contract for each project. The project will then proceed immediately without further Council action until after the project is complete. FINANCIAL IMPLICATIONS : Funding for this project will come from the “Stormwater Point Repairs and Pipe Cleaning” capital project budget funded by the Stormwater Utility. Funding is available and has been budgeted, appropriated and allocated to Project No. 17-090 (SW1501). BOARD/COMMISSION RECOMMENDATION : Not applicable. STAKEHOLDER PROCESS : None. ALTERNATIVES : Alternative No. 1 – No Action Under this alternative, the City would not create an approved list of contractors to make repairs to the existing storm sewer system if and when emergencies occur. Under this alternative, the risk of storm sewer overflows and backups increases which creates flooding, property damage, and safety issues to the public. Alternative No. 2 – Place Mains on the Rehabilitation List Under this alternative, the City would make no immediate improvements and would not create an approved list of contractors for emergency repairs. Any emergency issues would be placed on a rehabilitation list and prioritized by the level of importance for future rehabilitation projects. This would significantly increase the time it takes to repair the main. Again, there would be a risk that flooding, property damage, and a safety issue would still be present to the public.
