Section 17-10-06(a), Chapter 10, Title XVII of the Pueblo Municipal Code, as amended, is hereby modified to read as follows: Sec. 17-10-06. – Special sign districts. . . . SECTION 2. Chapter 10, Title XVII of the Pueblo Municipal Code, as amended, is hereby modified by the amendment of Section 17-10-15 as follows: Sec. 17-10-15. — Appendix A. This Ordinance, and the amendments made herein to Title XVII of the Pueblo Municipal Code shall be subject to administration and enforcement in accordance with Chapters 5 and 7 of Title XVII, Pueblo Municipal Code, as amended. Any person who violates any provision of this Ordinance or the amendments made herein to Title XVII of the Pueblo Municipal Code shall be guilty of a municipal offense and subject to punishment and all other remedies as provided in Chapter 7 of Title XVII of the Pueblo Municipal Code, as amended. SECTION 4. This Ordinance shall become effective immediately after final passage and approval. Nawrocki and Members of City Council CC: Sam Azad, City Manager VIA: Brenda Armijo, Acting City Clerk FROM: Steven Meier, Director of Planning and Community Development SUBJECT: AN ORDINANCE AMENDING CHAPTER 10 OF TITLE XVII OF THE PUEBLO MUNICIPAL CODE ADDING ADDITIONAL AREA FOR HIGH- RISE SIGNS TO THE HIGH-RISE SIGN DISTRICT NUMBER 2 SUMMARY: Attached for consideration is a text amendment submitted by the applicant, NuVue Pharma, LLC that will amend Chapter 10 of Title XVII of the Pueblo Municipal Code adding additional area for high rise signs to the High-Rise Sign District Number 2. PREVIOUS COUNCIL ACTION: None. BACKGROUND: NuVue Pharma, LLC, in accordance with Section 17-6-1, Chapter 10, Title XVII of the Pueblo Municipal Code, has requested an amendment to the sign code to modify High-Rise Sign District 2 to include 4530 Dillon Drive, north to the proposed overpass on I-25, on both sides of Dillon Drive. Currently, the sign code allows pole signs up to 200 square feet and 30 feet tall on the subject properties. The proposed amendment would allow signs to be located an average of 700 feet from I-25, along the 6,000-foot portion of Dillon Drive that has no frontage along I-25. The remaining 2,000 foot portion of Dillon Drive proposed to be included in the District 2 High- Rise Sign District 2 has frontage along I-25. When the sign code that included the High-Rise sign district was created in 2005, higher signs were allowed on properties near I-25. The 2005 District 2 High-Rise area included some of the properties along Dillon Drive, if their sign was within 1,100 feet of I-25, and high-rise signs were allowed along Elizabeth Street in High Rise Sign District 1. According to Planning and Community Development records, when these sign districts where created in 2005, the high-rise signs located at Comfort Inn, Conoco, Wingate, Village Inn, and Econolodge, were all existing (located within High-Rise Sign District 1 and not located adjacent to I-25); thereby, making them legal rather than non-conforming. Between the adoption of the sign code in 2005 and amendment in 2011, the only high- rise sign constructed on property that did not front I-25 was the Sunwest Credit Union/Starbucks high-rise sign at 700 Eagleridge Boulevard. When the sign code was amended in 2011, City Council amended Districts 1 and 2 to clarify that high-rise signs must be placed on the frontage roads that were adjacent to I-25. Because the high-rise signs in District 1 were existing, the portion of Elizabeth Street that was not fronting I-25 was not removed from the High-Rise Sign District 1. However, since Dillon Drive was not constructed in close proximity to I-25 and had no existing high- rise signs, the sign code amendment removed Dillon Drive from High-Rise Sign District 2. FINANCIAL IMPLICATIONS: There are no financial implications for the proposed change. BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission, at their November 8, 2017 Regular Meeting, by a vote of 0 in favor and 5 opposed (Lujan-Slak absent, Castellucci abstained) to approve a motion to recommend the proposed application with the following condition: 1. The High-Rise District 2 shall only be modified to allow high rise signs on Dillon Drive for 1,000 feet north and south of the intersection of Eagleridge Boulevard. STAKEHOLDER PROCESS: Not applicable. ALTERNATIVES: If City Council does not approve this Ordinance, Title XVII of the Pueblo Municipal Code will not be amended to reflect the proposed changes relating to zoning. RECOMMENDATION: The Planning and Zoning Commission, at their November 8, 2017 Regular Meeting voted to not recommend approval of the proposed text amendment. If City Council chooses to approve an amendment to the High-Rise District 2, the Planning and Community Development Department recommends that the area shall be modified to allow high rise signs on Dillon Drive along properties fronting the east and west sides of Dillon Drive between the south boundary of the North Pueblo Commercial Park Filing No. 2 and1,000 feet north of the Eagleridge Blvd Interchange. The Planning and Community Development Department is recommending, if City Council is considering the approval of the amendment to Chapter 10 of Title XVII of the Pueblo Municipal Code Adding Additional Area for High-Rise Signs to the High-Rise Sign District Number 2, that the Ordinance be amended to reduce the area that the High-Rise District is expanded since there is no development extending beyond 1,000 feet north of the Eagleridge Blvd and Dillon Drive intersection. Below is the proposed wording for a motion to amend the Ordinance. Proposed Amendment to Ordinance Only if Ordinance is being considered for approval.
