HomeMy WebLinkAbout03759 • T 40140'7x_ r- R'�`°� 'Z7 8 j NOV 2 6 1973 BOOR 1766 PAGE291 ORDINANCE NO. 3759 AN ORDINANCE ANNEXING AN AREA BEING A PORTION OF LAVISTA HILLS STABLE SUBDIVISION AND A PORTION OF THE NWS OF SECTION 22 AND A PORTION NE4 OF SECTION 21, TOWNSHIP 21 SOUTH, RANGE 65 WEST OF THE 6TH P.M. , PUEBLO COUNTY, COLORADO. BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. The City Council hereby finds that the territory proposed to be annexed and which is described in Section 2 of this Ordinance is eligible for annexation because: (1)" The territory has not less than 1/6 of its perimeter contiguous with existing city limits; and (2) A community of interest exists between the territory proposed to be annexed and the annexing municipality; and (3) The territory proposed to be annexed will be urbanized in the near furture; and (4) The territory proposed to be annexed is capable of being integrated with the City of Pueblo; and (5) No land held in identical ownership is divided into separ- ate tracts or parcels without the written consent of the owners; and (6) No land held in identical ownship, comprising twenty acres or more, which together with buildings and improvements situated thereon, has an assessed value in excess of Two Hundred Thousand Dollars for ad valorem tax purposes for 1972, is included with- out the written consent of the owner(s) ; and (7) The annexation petition has been signed by the owners of 100% of the land proposed to be annexed. SECTION 2. That area commonly known as being South of LaVista Hills Stable ,�.1ndl/t.i on And ),'.'_?IA -io _)af"'_-_•�:dla'" Y d scc.±.1J,?.d AS '_o'.LJ'✓S: • A portion of LaVista Hills Stables Subdivision, according to the recorded plat thereof, as filed for record April 3, 1959, and a portion of the NWS of Section 22, and a portion of the NE1 of the NE1, and a portion of the SE` of the NE; of Section 21, Township 21 South, Range 65 West of the 6th P.M. , being more particularly described as follows: Beginning at the Northeast corner of said Section 21; thence N. 89° 57' E., along the North line of said Section 22, a distance of 30.00 feet to a point on the East right-of-way line of a County (Burnt Mill) Road; thence S. 00° 04' W. , along said East right-of-way line, a distance of 1788.57 feet; thence S. 89° 57' W. , 1 parallel to said North line of Section 21, a distance of 540.99 feet, more or less, to a point on the Easterly right-of-way line of the Arkansas Valley Conduit; thence Northerly along said Easterly right-of-way line to its intersection with the South boundary line of Lots 3 and 4 of said LaVista Hills Stables Subdivision, if extended Westerly; BOOK 1.766 PAGE 292 thence N. 890 57' E. , along said South boundary if extended Westerly, and said South line of LaVista Hills Stables Sub- division, a distance of 1022.85 feet, to a point on the East line of said Section 21; thence N. 00° 04' E. , along said East line of Section 21, a distance of 250.00 feet to the point of beginning; containing 28.6 acres, more or less, be,. 'and the same hereby is annexed to the City of Pueblo, Colorado. SECTION 3. This Ordinance shall become effective immediately upon final passage and approval.
