HomeMy WebLinkAbout13858 RESOLUTION NO. 13858 A RESOLUTION AUTHORIZING THE CITY OF PUEBLO TO REFUND SANITARY SEWER FEES TO SUSAN MONTOYA WHEREAS, the City’s Wastewater Department has been notified that the property at 1503 th West 20 Street has a septic tank and is not connected to the City’s sewer system.; and WHEREAS, Susan Montoya has incorrectly been charged and has paid wastewater fees on that property; and WHEREAS, pursuant to Section 16-6-6 of the Pueblo Municipal Code, the Director of Wastewater has determined that grounds exist for a refund pursuant to Section 16-6-5 of the Code; and WHEREAS, a refund for the paid amount can only be authorized by Pueblo City Council; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The City shall refund Susan Montoya the sum of $835.83 for a refund of wastewater fees th paid for 1503 West 20 Street. SECTION 2. Such refund shall be paid through the Claim Settlement Fund, Account Number 52541100 55007 in the amount of $835.83. SECTION 3. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Resolution and the contract to effectuate the transactions described therein. SECTION 4. This Resolution shall become effective immediately upon passage and approval. PREVIOUS COUNCIL ACTION : None BACKGROUND : The Wastewater Department was recently informed of a septic tank within the City of Pueblo th limits. Susan Montoya, who is the owner of the property located at 1503 West 20Street, discovered she was connected to a septic tank while having plumbing work performed at her th home. The connection was verified through a plumber. The property at 1503 West 20 is beyond the 400-foot requirement to connect to the City’s sewer system and will have to remain on a septic tank. Ms. Montoya is seeking credit on the sewer charge that was paid on this property that has never been connected to the City sanitary sewer system. Pursuant to City Ordinance 16-6-7, refunds based upon sewer user charges appearing on billings issued more than ninety (90) days prior to receipt of a written request can only be authorized by City Council and are limited to a maximum period of two years. Ms. Montoya is requesting the refund of wastewater fees in the amount of $835.83. FINANCIAL IMPLICATIONS : The refund of $835.83 will be paid from Claim Settlement Fund, Account Number 52541100 55007. Funds are available and have been appropriated.
