HomeMy WebLinkAbout09208 ORDINANCE NO. 9208 AN ORDINANCE AMENDING ORDINANCE NO. 9169 TO CORRECT A NUMBERING ERROR IN SAID ORDINANCE BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. All references in Ordinance No. 9169 to the addition of a new Section 11, Chapter 6 of Title I, shall be amended to instead reference Section 12, Chapter 6 of Title I of the Pueblo Municipal Code. SECTION 2. Any person who violates Section 1-6-12 of the Pueblo Municipal Code, as amended hereby, or violates this Ordinance as related thereto, shall be guilty of a municipal offense and shall be punished as provided by said Section 1-6-12. SECTION 3. Except as modified by this Ordinance, all other terms and provisions of Ordinance No. 9169 shall remain in full force and effect as written. SECTION 4. The officers of the City are directed and authorized to perform any and all acts consistent with the intent of this Ordinance to implement the policies and procedures described herein. SECTION 5. This Ordinance shall become effective thirty (30) days following final passage and approval. Kogovsek, City Attorney SUBJECT: AN ORDINANCE AMENDING ORDINANCE NO. 9169 TO CORRECT A NUMBERING ERROR IN SAID ORDINANCE SUMMARY: Attached is an Ordinance amending Ordinance No. 9169 to correct a numbering error in said ordinance, specifically amending the language designating Contempt of Court as “Section 11, Chapter 6 of Title I” to “Section 12, Chapter 6 of Title I.” PREVIOUS COUNCIL ACTION: Council previously passed and approved Ordinance No. 9169 on September 11, 2017. BACKGROUND: Council approved Ordinance No. 9169 to set forth contempt of court as a separate and distinct municipal offense. The ordinance designated Contempt of Court to be included in the Pueblo Municipal Code as a new Section 11, Chapter 6 of Title I. However, that section number was previously approved for and houses the provision related to the Municipal Court Marshal. The section numbering in Ordinance No. 9169 should be corrected to resolve this conflict, where Contempt of Court becomes Section 12, Chapter 6 of Title I. FINANCIAL IMPLICATIONS: None. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: Not applicable to this Ordinance. ALTERNATIVES: City Council may choose not to approve this Ordinance in which case, the conflict between the two enacted provisions will continue. RECOMMENDATION: Approve the Ordinance.
