A RESOLUTION AWARDING A CONSTRUCTION
CONTRACT IN THE AMOUNT OF $137,995 TO K.R.
SWERDFEGER CONSTRUCTION, INC., AND SETTING
FORTH $114,005 FOR CONTINGENCIES, FOR PROJECT
NO. 17-092 (SW1704) FOUNTAIN CREEK TRAIL
RELOCATION, AND AUTHORIZING THE PURCHASING
AGENT TO EXECUTE THE SAME
WHEREAS, proposals for PROJECT NO. 17-092 (SW1704) – Fountain Creek
Trail Relocation have been received and examined; and
WHEREAS, the proposal of K.R. Swerdfeger Construction Inc. of Pueblo West,
Colorado was the lowest of those bids determined to be responsible; NOW,
THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
A contract for PROJECT NO. 17-092 (SW1704) - Fountain Creek Trail Relocation
is hereby awarded to said bidder in the amount of $137,995.
SECTION 2.
Funds for Project 17-092 (SW1704) shall be from the Stormwater Utility User Fund.
SECTION 3.
The Purchasing Agent is hereby authorized to execute said contract on behalf of
Pueblo, A Municipal Corporation, and the City Clerk shall affix the seal of the City thereto
and attest the same.
SECTION 4.
In addition to the amount of the bid set forth, as aforementioned, an additional
amount as stipulated in this section is hereby established for contingencies and additional
work.
Contingencies and Additional Work………$114,005
SECTION 5.
All reimbursement funds from FEMA for Project 17-092 (SW1704) shall be
deposited into Project SW1704 account.
SECTION 6.
The officers and staff of the City are directed and authorized to perform any and
all acts consistent with the intent of this Resolution and the contract to effectuate the
transactions described therein.
SECTION 7.
This Resolution shall become effective immediately upon passage and approval.

SUBJECT:

EXECUTE THE SAME
SUMMARY:
This Resolution awards a construction contract to K.R. Swerdfeger Construction, Inc. for
Project No. 17-092 (SW1704) Fountain Creek Trail Relocation. The project will replace
and relocate the pedestrian trail that was damaged during the June 2015 flood.
PREVIOUS COUNCIL ACTION
:
City Council, on October 10, 2017, approved Resolution 21371 which established this
project and transferred funds in the amount of $252,000.
BACKGROUND
:
In June of 2015, the Fountain Creek experienced flooding that caused damage along the
th
Creek including the concrete trail located on the east side near East 11 Street.
Approximately, 1,600 feet of concrete trail was lost in the flooding.
On July 16, 2015, President Obama issued a major disaster declaration for the State of
Colorado that allowed for Federal relief funds through FEMA of which this Trail Relocation
project qualifies. To obtain the Federal funds the City must upfront the cost of the
construction and apply for reimbursement from FEMA during the construction phase.
FINANCIAL IMPLICATIONS
:
The cost of the construction project was bid at $137,995 with contingencies of $114,005.
Funds are available from the Storm Utility User Funds and have been budgeted and
appropriated to Project No. 17-092 (SW1704). Reimbursement requests will be
submitted to FEMA and all payments to be deposited into SW1704.

ALTERNATIVES
:
Alternative No. 1 – No Action
Under this alternative, the trail will not be replaced, leaving a gap in the trail system along
th
the Fountain Creek near East 11 Street, and the City will lose the opportunity to have
FEMA relief funds help pay for the replacement.
RECOMMENDATION
:
Approval of the Resolution.
