ORDINANCE NO. 9201
AN ORDINANCE AMENDING ZONING RESTRICTIONS
FOR PROPERTY LOCATED AT 401 SOUTH PRAIRIE
AVENUE
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The zoning restrictions covering the following described property and generally identified
in the attached Rezone Exhibit is hereby changed from R-2, Single Family Residential
District to R-3, One- and Two-Family Residential District:
Beginning at a point at the right-of-way monumentation at the intersection
of Thatcher Avenue and Prairie Avenue;
Thence N 89° 58’ 15” W along the right-of-way of Thatcher Avenue a
distance of 329.92 Feet;
Thence N 00° 00’ 20” W along the right-of-way of Henry Avenue a distance
of 660.26 Feet;
Thence S 89° 55’ 34” E along the right-of-way of Nuckolls Avenue a
distance of 329.98 Feet;
Thence S 00° 00’ 00” E along the right-of-way of Prairie Avenue a distance
of 600.01 Feet to the Point of Beginning.
Said Parcel containing 217,808.56 Square Feet (5.00 Acres) more or less.
SECTION 2.
The officers and staff of the City are directed and authorized to perform any and
all acts consistent with the intent of the Ordinance to effectuate the policies and
procedures described herein.
SECTION 3.
The rezoning is approved with the following conditions:
1. Provide the following landscape improvements, and provide a landscape plan that
is approved by staff prior to being scheduled for City Council:
a. Provide irrigation to all landscaping areas that currently do not have
irrigation
b. Plant grass in the tree-lawn along Prairie Avenue.
c. Add gravel to the dirt area along Nuckolls Avenue
d. Re-establish grass, at locations that are not currently landscaped with
shrubs, along Henry Avenue.
e. Add four (4) shade trees mixed in with the existing evergreen trees, along
Thatcher Avenue.
2. Public improvements and parking lot improvements will be required at the time of
building permit.
3. Detention and water quality will be required at the time of development.
Condition 1 must be complied with within one (1) year from the date of approval of the
rezoning at City Council.
SECTION 4.
This Ordinance shall become effective immediately upon final passage and
approval.

SUBJECT: AN ORDINANCE AMENDING ZONING RESTRICTIONS FOR PROPERTY
LOCATED AT 401 SOUTH PRAIRIE AVENUE
SUMMARY:
Applicant is requesting to rezone the subject property from R-2 to R-3, One and Two Family
Residential District
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
The subject property is located at 401 S. Prairie Avenue. The applicant is requesting to rezone
the property from R-2 to R-3 to utilize the property for the Salvation Army Red Shield Program.
The proposed use is not permitted in the existing R-2 Zone District; however, it is allowed as a
Special Use Permit in the R-3 Zone District as a Charitable Institution.
The Salvation Army Red Shield program is a family oriented center that provides the following
services:
Family outreach
Utility assistance
Children’s programs
Child care for families during classes
Gardening
Worship center
Family services such as rental assistance, classes, homework assistance, etc.
Family athletic leagues
Youth meal preparation (not for the homeless)
Emergency disaster services
The use prohibits any type of homeless services and the opening of the facility for a warming
shelter and store.
FINANCIAL IMPLICATIONS:
There are no financial implications for the City.
BOARD/COMMISSION RECOMMENDATION:
The Planning and Zoning Commission, at their October 11, 2017 Regular Meeting, voted 7-0 to
recommend approval with the following conditions:

STAKEHOLDER PROCESS:
The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing
to all property owners located within 300 feet of the subject property.
A Public Notice poster was placed on the subject property 15 days prior to the Public Hearing.
ALTERNATIVES:
If City Council does not approve this Ordinance, the current zoning would remain.
Upon request of City Council, the Ordinance could be returned to the Planning and Zoning
Commission for consideration of proposed modifications.
RECOMMENDATION:
Approval of the Ordinance.
