RESOLUTION NO. 13824
A RESOLUTION AUTHORIZING THE CITY OF PUEBLO TO
WAIVE THE SANITARY SEWER FEES FOR MIKE DALSIMER
FOR THE PERIOD OF APRIL 2016 TO OCTOBER 2017
WHEREAS, the City’s Wastewater Department has been notified that Mike Dalsimer was
charged wastewater fees but due to the property being vandalized was unable to discharge
wastewater to the City’s sanitary sewer system; and
WHEREAS, pursuant to Section 16-6-6 of the Pueblo Municipal Code, the Director of
Wastewater has determined that grounds exist for a waiver of sanitary sewer fees pursuant to
Section 16-6-5 of the Code; and
WHEREAS, an amount for the waiver can only be authorized by Pueblo City Council;
NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The City shall waive sewer fees for Mike Dalsimer, Board of Water Works account number
097201-030796 in the sum of $845.59 for the wastewater fees charged during the periods of April
2016 to October 2017.
SECTION 2.
Such waiver shall be applied to Board of Water Works account number 097201-030796
in the amount of $845.59.
SECTION 3.
The officers and staff of the City are directed and authorized to perform any and all acts
consistent with the intent of this Resolution and the contract to effectuate the transactions
described therein.
SECTION 4.
This Resolution shall become effective immediately upon passage and approval.

SUMMARY:
This Resolution authorizes the City of Pueblo to waive sanitary sewer fees to Mike Dalsimer for
the period of April 2016 to October 2017

BACKGROUND
:
The Wastewater Department received a written request from Mike Dalsimer, who is the owner of
the property located at 219 East 2nd Street. Mr. Dalsimer is seeking credit on the sewer charge
due to vandalism of the sanitary sewer service by a previous tenant. This left the sanitary sewer
inoperable from April 2016 to October 2017.
Pursuant to City Ordinance 16-6-7, refunds based upon sewer user charges appearing on billings
issued more than ninety (90) days prior to receipt of a written request can only be authorized by
City Council and are limited to a maximum period of two years. Mr. Dalsimer is requesting the
wastewater fees in the amount of $845.59 to be waived due to the property being unable to
discharge to the City’s sanitary sewer system.
FINANCIAL IMPLICATIONS
:
The sanitary sewer fees in the amount $845.59 will be waived from the Board of Water Works
account number 097201-030796.
