AN ORDINANCE APPROVING AMENDMENT TO THE
INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF
PUEBLO AND PUEBLO COUNTY FOR UPGRADES AND
ENHANCEMENTS TO THE DIGITAL TRUNKED RADIO (DTR)
COMMUNICATIONS SYSTEM NETWORK LOCATED IN PUEBLO
COUNTY, COLORADO
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Amendment to the Intergovernmental Agreement between the City of Pueblo,
a Municipal Corporation, and Pueblo County, Colorado for upgrades and enhancements
to Digital Trunked Radio System Network, attached hereto and having been approved as
to form by the City Attorney, is hereby approved.
SECTION 2.
The President of the City Council is hereby authorized and directed to execute said
Amendment to the Intergovernmental Agreement for and on behalf of the City, and the
City Clerk is directed to affix the seal of the City thereto and attest same.
SECTION 3.
The officers and staff of the City are directed and authorized to perform all acts
consistent with the intent of this Ordinance and the attached Amendment to effectuate
the transactions described therein.
SECTION 4.
This Ordinance shall become effective immediately upon final passage and
approval.

SUMMARY:
Attached is the amendment to the Intergovernmental Agreement (IGA) between the City
of Pueblo and Pueblo County for upgrades and enhancements to the Digital Trunked
Radio (DTR) Communications System Network utilized by both parties.
PREVIOUS COUNCIL ACTION:
Intergovernmental Agreement accepted by Council and signed on December 9, 2013.
BACKGROUND:
The City of Pueblo and Pueblo County own and operate identical NICE logging recorder
systems. The NICE logging recorder is responsible for recording audio for both 9-1-1
calls as well as radio communications received in each entity’s 9-1-1 Dispatch Center.
Each entity has suffered data loss on these systems resulting in unrecoverable
recordings, and together propose a cross-connection to provide a redundant backup for
each system to eliminate recording losses. The City and County wish to amend the IGA
to provide for critical audio backups of each other’s public safety logging recorder
systems. To secure these critical recordings will require minimal cost, space, and
maintenance, and connections will be maintained over existing City and County fiber
.
FINANCIAL IMPLICATIONS:
Minimal future hardware costs associated with long-term storage of audio recordings and
recording archives may be required.
BOARD/COMMISSION RECOMMENDATION:
None.

ALTERNATIVES:
If City Council does not approve this Ordinance, the cross-connection for audio back-up
of 9-1-1 calls will not be implemented. Lost recordings of audio calls will occur.
RECOMMENDATION:
Approval of the Ordinance.

AMENDMENT TO THE IGA BETWEEN THE CITY OF PUEBLO AND PUEBLO COUNTY
FOR UPGRADES AND ENHANCEMENTS TO THE DIGITAL TRUNKED RADIO (DTR)
COMMUNICATIONS SYSTEM NETWORK IN PUEBLO COUNTY, COLORADO
This Amendment is entered into as of the 13Adayof N o1 a 0,t1 el , 2017 ("Effective Date"), by
and between the City of Pueblo, Colorado, a Municipal Corporation("City"), and Pueblo County,
Colorado ("County").
WHEREAS, the County and Motorola Solutions, Inc. ("Motorola") entered a
Communications System Agreement ("CSA") effective as of June 26, 2013, pursuant to which
Motorola sells and County purchases certain radio system upgrades and enhancements to the
County's and City's 700/800 MHz Digital Trunked Radio ("DTR") System ("DTRS"); and
WHEREAS, funds were appropriated and distributed to the County from the United States
Department of Homeland Security, Federal Emergency Management Agency ("FEMA") for the
2012 and 2013 Chemical Stockpile Emergency Preparedness Program ("CSEPP"), and a portion
of the CSEPP funding is used by the County to pay for certain radio system upgrades and
enhancements to the City's DTR equipment and sites; and
WHEREAS, the City and County entered an Intergovernmental Agreement ("IGA")
effective December 9, 2013 to include City in and amend certain terms of the CSA; and
WHEREAS, the City, County, and Motorola entered an Amendment to the CSA effective
December 9, 2013 in order to carry out the terms of the IGA and incorporate the City into certain
sections of the CSA; and
WHEREAS, the City and County own and operate identical NICE logging recorder
systems and each has suffered data loss on these systems resulting in unrecoverable recordings,
and together propose a cross-connection to provide a redundant backup for each system and to
eliminate such losses; and
WHEREAS, the City and County wish to amend the IGA to provide for critical audio
backups of each other's public safety logging recorder systems; and
WHEREAS, such additional backups will require minimal cost, space, and maintenance,
and connections will be maintained over existing City and County fiber.
NOW THEREFORE, in consideration of the foregoing recitals, and the promises and
conditions set forth below, the parties agree to amend the IGA as follows:
Section 1. "System Infrastructure, Services and Training."is hereby amended through the addition
of a new subsection(j) to read:
(j) The City and County shall provide critical audio backups of each other's public safety
logging recorder systems. The cross-connection shall provide at least a 24-channel analog
backup for each entity. City will backup and house the County's data, while County will
backup and house City's data. The channel bank, as well as minor auxiliary items housed
with each party, shall be used to facilitate the connectivity and process. Not all talk-groups
will be backed up. Only the DTRS radio and 9-1-1 audio transmissions for law, fire,
medical, and tactical talk-groups will be backed-up. These tactical talk-groups are
predetermined and agreed upon by the 9-1-1 Directors of the City and County. Each party
shall be responsible for any costs incurred or labor utilized in backing up and storing the
other's public safety logging recorder system. Each party shall store said public safety
logging recorder system data for a period of not less than two (2) years. Either party may
request a copy of its backed-up recordings at any time, where the requesting party will be
responsible for paying any costs associated with providing and storing the copy. No
software or related software documentation will be transferred.
