HomeMy WebLinkAbout09194 ORDINANCE NO. 9194 AN ORDINANCE AMENDING SECTION 9-14-2 OF THE PUEBLO MUNICIPAL CODE RELATING TO CHRISTMAS TREE SALES PERMITS AND ALLOWING SALES THEREUNDER TO COMMENCE THANKSGIVING DAY BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (brackets indicate matter being deleted, underscoring indicates new matter being added) SECTION 1. Section 2 of Chapter 14 of Title IX of the Pueblo Municipal Code is amended to read as follows: Sec. 9-14-2. Application for permit; content. Any person desiring a permit to sell Christmas trees or parts thereof within the City shall make application therefor to the Director of Finance. Such application shall set forth the name, address and telephone number of the applicant; the location and owner of the property where the trees are to be sold; and the zone district in which such property is located. Each permit \[\] shall authorize the sale of the items covered in this Chapter for the period from December 1 Thanksgiving Day to December 27 of the calendar year in which the permit is issued. A permit fee of one hundred dollars ($100.00) for each location where such items are to be sold shall be paid to the Director of Finance. Seventy-five dollars ($75.00) of the permit fee shall be refunded to the applicant if all appropriate sales tax is paid to the City and the location is cleared of all trees, wreaths, stands, refuse and debris, to the satisfaction of the Chief of the Fire Department, by December 27 of each year. No permit granted hereunder shall be transferable to another person or location. SECTION 2. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Ordinance and the contract to effectuate the transactions described therein. SECTION 3. This Ordinance shall become effective immediately upon final passage and approval. Nawrocki and Members of City Council VIA: Gina Dutcher, City Clerk FROM: Sam Azad, City Manager SUBJECT: AN ORDINANCE AMENDING SECTION 9-14-2 OF THE PUEBLO MUNICIPAL CODE RELATING TO CHRISTMAS TREE SALES PERMITS AND ALLOWING SALES THEREUNDER TO COMMENCE THANKSGIVING DAY SUMMARY: This Ordinance amends the municipal code changing the initial day covered by a permit for st Christmas tree sales from December 1 to Thanksgiving Day. PREVIOUS COUNCIL ACTION: City council passed Ordinance No. 5085 on September 26, 1983 requiring a permit for Christmas tree sales for those not regularly engaged in in the business of growing or selling stth trees or plants, and establishing a permit from December 1 to December 27. BACKGROUND: st Permit holders are currently limited to the sale of Christmas trees from December 1 to th December 27. Permit holders suggest that the current dates negatively affect their ability to compete with other retail outlets that begin selling trees on Thanksgiving Day. This ordinance will change the effective starting date of the permit to Thanksgiving Day. Greenhouses and other businesses regularly in the business of selling trees and plants are not required to obtain a permit to sell Christmas trees and are unaffected by this ordinance. FINANCIAL IMPLICATIONS: N/A BOARD/COMMISSION RECOMMENDATION: N/A STAKEHOLDER PROCESS: N/A ALTERNATIVES: If City Council does not approve this ordinance, permit holders will continue to be at a disadvantage.
