SUBJECT: AN ORDINANCE AMENDING ZONING RESTRICTIONS FOR PROPERTY
LOCATED BETWEEN 2650 AND 2700 SOUTH PRAIRIE, AND EAST OF
2700 THROUGH 2722 SOUTH PRAIRIE
SUMMARY:
Applicant is requesting to rezone the subject property from R-2 and B-1 to B-P, Business
Park District.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
The subject property is located between 2650 and 2700 South Prairie, and east of 2700
through 2722 South Prairie. The applicant is requesting to rezone the property from R-2
and B-1 to B-P, Business Park District to utilize the property for existing uses including
rental garages generally used for storage, commercial facilities, auto body repair,
mechanical repair, contractor’s shops, a tow yard, and warehouses which are not
permitted in the R-2 and B-1 zone districts. These uses are permitted by right in the B-P
Zone District, except for a tow yard and warehousing uses requiring special use permits
in a B-P Zone District.
FINANCIAL IMPLICATIONS:
There are no financial implications for the City.
BOARD/COMMISSION RECOMMENDATION:
The Planning and Zoning Commission, at their September 13, 2017 Regular Meeting,
voted 6-0 with Commissioner Lujan-Slak absent, to recommend approval.
STAKEHOLDER PROCESS:
The Planning Department sent out Notice of the Planning and Zoning Commission Public
Hearing to all property owners located within 300 feet of the subject property.
A Public Notice poster was placed on the subject property 15 days prior to the Public
Hearing.
ALTERNATIVES:
If City Council does not approve this Ordinance, the current zoning would remain.
Upon request of City Council, the Ordinance could be returned to the Planning and Zoning
Commission for consideration of proposed modifications.
RECOMMENDATION:
Approval of the Ordinance.

AN ORDINANCE AMENDING ZONING RESTRICTIONS
FOR PROPERTY LOCATED BETWEEN 2650 AND 2700
SOUTH PRAIRIE, AND EAST OF 2700 THROUGH 2722
SOUTH PRAIRIE
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The zoning restrictions covering the following described property and generally
identified in the attached Rezone Exhibit is hereby changed from R-2, Single Family
Residential and B-1, Subregional Business District to B-P, Business Park District:
Parcel No. 1

Commencing at a point on the west line of Section 14, T21S, R65W, 6
P.M. a distance of 2727 feet North of the SW corner; thence East 739 feet
more or less, to a point on the West Right-of-way of Minnequa Ditch; thence
North along the West line of Right-of-way of Minnequa Ditch 214 feet more
or less, to a point; thence West 739 feet, more or less to a point on the West
line of said Section 14; thence South along said West line of said Section
14, a distance of 214 feet more or less to the POB Except any portion of
thereof lying with Prairie Avenue, and Excepting therefrom that portion of
the Southwest ¼ of the Northwest ¼ of Section 14, Township 21 South,
Range 65 West, Described as follows:
Beginning at a point 2513. 4 feet south of and 33 feet east of the Northwest
corner of the said Section 14; thence Due South, and parallel with the West
line of said Section 14, a distance of 69 feet; thence North 89̊ 20’ East, a
distance of 150.0 feet to a point; thence due North from said point 69 feet;
thence S 89̊ 20’ W, a distance of 150.0 feet to the Point of Beginning, said
exception being the tract of land conveyed by deed dated May 4, 1964 and
recorded August 17, 1964 under Reception No. 266387, in Book 1551 at
Page 632.
And further excepting that portion thereof conveyed by deed recorded
January 31, 1975 in Book 1804 at Page 403. County of Pueblo, State of
Colorado.
AND the East 33 feet of Prairie Avenue lying adjacent to the aforementioned
parcel.

Commencing at the Southwest corner of the said Section 14; thence North
along the West line of the said Section 14 a distance of 2117 feet; thence
North 89 degrees 20 minutes East a distance of 401.45 feet to the Point of
Beginning of the herein described parcel of land; thence North parallel to
the west line of Section 14 a distance of 610 feet to a point on the East-
West Center Line of the said Section 14, thence North 89̊ 20’ East along
said center line a distance of 338.65 feet to a point on the westerly right of
way line of the Minnequa Ditch; thence Southerly along said right of way
line a distance of 611.12 feet; thence S 89̊ 20’ W a distance of 375.55 feet
to the point of beginning, County of Pueblo, State of Colorado.
SECTION 2.
The officers and staff of the City are directed and authorized to perform any and
all acts consistent with the intent of the Ordinance to effectuate the policies and
procedures described herein.
SECTION 3.
This Ordinance shall become effective immediately upon final passage and
approval.
